<br />(ii) Robinson shall assure that following the <br />completed reclamation of Reclamation Phase "3" the elevation of <br />the lands therein will not be lower than one five (5) foot con- <br />tour interval below that shown on Exhibit F. The lands may be <br />allowed to remain or be reclaimed at higher contour levels so <br />long as all other requirements of the Permit Application are <br />satisfied, such as drainage and slope requirements. <br />(iii) Robinson shall not create or cause or . <br />allow to be created any topsoil stockpile areas in Mining <br />Stage "3" except as specifically described and depicted on <br />Exhibit D-1. <br />(c) Robinson covenants not to undertake or cause <br />or allow to be undertaken, any Major, Moderate or Minor <br />Disturbances within two hundred (200) feet of the northern, <br />eastern and southern boundaries of the Lakewood Lands as depicted <br />on Exhibits D-1 and F. <br />(d) Robinson covenants to strictly comply with all <br />terms, duties, and obligations contained in or imposed by the <br />Permit Application and/or the Mining Permit it expects to be <br />issued by the MLRB. <br />(e) Robinson covenants to construct or cause to be <br />constructed a new three (3) strand fence along the boundaries of <br />the Lakewood Lands within the City of Lakewood, at the request of <br />Lakewood, at any time that a Major, Moderate or Minor Disturbance <br />takes place inside the municipal limits of Lakewood. <br />(f) Robinson covenants to erect or cause to be <br />erected a reasonable number of warning signs along the boundaries <br />of the Lakewood Lands within the City of Lakewood, at the request <br />of Lakewood at any time that a Major, Moderate or Minor Disturb- <br />ance takes place inside the municipal limits of Lakewood. <br />Educational interest signs describing clay formation, mining <br />uses, and reflecting other similar information, in a style <br />acceptable to Lakewood, may be erected, at Robinson's option, at <br />locations mutually acceptable to both parties along the bounda- <br />ries of the Lakewood Lands. <br />4. Covenants by Lakewood. <br />By entering into and executing this Agreement, <br />Lakewood covenants to deliver to the MLRB and/or Robinson, on or <br />before November 25, 1985, a duly executed letter, from an author- <br />ized Lakewood city offirial, stating that the use of extracting <br />clay and silica sands from certain lands in Jefferson County, <br />which are adjacent to and northwest of the Lakewood Lands, would <br />be a non-conforming use if expanded onto the Lakewood Lands; but, <br />further stating that Lakewood will not oppose, at the present <br />-4- <br />
