(ii) Robinson shall assure that following the
completed reclamation of Reclamation Phase "3" the elevation of
the lands therein will not be lower than one five (5) foot con-
tour interval below that shown on Exhibit F. The lands may be
allowed to remain or be reclaimed at higher contour levels so
long as all other requirements of the Permit Application are
satisfied, such as drainage and slope requirements.
(iii) Robinson shall not create or cause or .
allow to be created any topsoil stockpile areas in Mining
Stage "3" except as specifically described and depicted on
Exhibit D-1.
(c) Robinson covenants not to undertake or cause
or allow to be undertaken, any Major, Moderate or Minor
Disturbances within two hundred (200) feet of the northern,
eastern and southern boundaries of the Lakewood Lands as depicted
on Exhibits D-1 and F.
(d) Robinson covenants to strictly comply with all
terms, duties, and obligations contained in or imposed by the
Permit Application and/or the Mining Permit it expects to be
issued by the MLRB.
(e) Robinson covenants to construct or cause to be
constructed a new three (3) strand fence along the boundaries of
the Lakewood Lands within the City of Lakewood, at the request of
Lakewood, at any time that a Major, Moderate or Minor Disturbance
takes place inside the municipal limits of Lakewood.
(f) Robinson covenants to erect or cause to be
erected a reasonable number of warning signs along the boundaries
of the Lakewood Lands within the City of Lakewood, at the request
of Lakewood at any time that a Major, Moderate or Minor Disturb-
ance takes place inside the municipal limits of Lakewood.
Educational interest signs describing clay formation, mining
uses, and reflecting other similar information, in a style
acceptable to Lakewood, may be erected, at Robinson's option, at
locations mutually acceptable to both parties along the bounda-
ries of the Lakewood Lands.
4. Covenants by Lakewood.
By entering into and executing this Agreement,
Lakewood covenants to deliver to the MLRB and/or Robinson, on or
before November 25, 1985, a duly executed letter, from an author-
ized Lakewood city offirial, stating that the use of extracting
clay and silica sands from certain lands in Jefferson County,
which are adjacent to and northwest of the Lakewood Lands, would
be a non-conforming use if expanded onto the Lakewood Lands; but,
further stating that Lakewood will not oppose, at the present
