~i <br /> <br />Mrs. Ruth Gray - 2 - May 18, 1988 <br />I would like to take this opportunity to summarize the site history as <br />documented in our files. <br />On February 26, 1987 we received information by phone that an unpermitted <br />mining operation was active near the Norwood airstrip. <br />In late September, 1987 we received a copy of a letter from the San Miguel <br />County Planning Department to Mr. Bill Carstons regarding the need for County <br />Planning Commission approval prior to conducting gravel crushing operations. <br />A copy of this letter is enclosed. County approval is necessary prior to <br />receiving Mined Land Reclamation Board approval. <br />In January, 1988 the Telluride Mountain Journal contacted the Division by <br />phone requesting information about five separate operations which Skelton, <br />Inc. matt' have recently operated. Our files indicated that Skelton, Inc. did <br />not have an approved permit for arty operation in Montrose or San Miguel <br />Counties. <br />On January 28, 1988 the Telluride Mountain Journal published an article which <br />alleged that Skelton, Inc. was conducting unpermitted mining operations in San <br />Miguel County. A copy of this article was forwarded to the Division. A copy <br />of the article is enclosed. <br />In early March, 1988 the Division received a copy of a letter from the San <br />Miguel County Planning Department to Skelton, Inc. This letter urged Skelton, <br />Inc. to seek County approval prior to continuing or initiating mining <br />operations. A copy of this letter is enclosed. County approval is required <br />prior to obtaining Mined Land Reclamation Board approval. <br />On March 16, 1988 I inspected the Hawk-Shaffer Pit operation, and met with <br />Dwayne Skelton and yourself. As the inspection report indicates, Skelton, <br />Inc. was advised at the time of the inspection to discontinue all mining and <br />gravel removal operations until such time as a permit is issued by the Board. <br />Skelton, Inc. was also advised that both operations were to be permitted as <br />either a Limited Impact (110) or Regular (112) operation. The type of permit <br />required (110 or 112) is dependent upon the acreage of the land to be included <br />within the operation. Although you have received the inspection report, <br />another copy is enclosed. <br />On April 4, 1988 we received from Skelton, Inc. a 110 permit application for <br />the Montrose County portion of the operation (9.75 acre Hawks Pit). <br />On April 14, 1988 Skelton, Inc. was notified by mail that the 110 permit <br />application was incomplete, since it did not include the San Miguel County <br />portion of the operation. Skelton, Inc. was advised that a Regular (112) <br />application would be necessary for this site. A copy of this letter is <br />enclosed. A 112 application form was mailed to Skelton, Inc. in a separate <br />envelope on the same ddy. <br />On April 14, 1988 we received a copy of a letter from the San Miguel County <br />Planning Department to Skelton, Inc. stating that the County has approved the <br />proposed operation. <br />
