Box 125 <br />Norwood, CO 81423 <br />Re: Hawks and Shaffer Pit Permit Applications (File No. M-88-037) <br />Dear Mrs. Gray: <br />We have received a second Limited Impact Operation (110) permit application <br />from Skelton, Inc. for the operation located in Section 13, T45N, R13W (Hawks <br />Pit, Shaffer Pit). The second 110 permit application is for the 9.72 acre <br />Shaffer Pit in San Miguel County. <br />As you have requested, we will consider the two 110 applications as a single <br />112 submittal. However, as we stated in our letter of April 14, 1988, it is <br />necessary fora 112 permit application to satisfy the requirements of Rule 2 <br />of the Mineral Rules and Regulations (the rules and regulations pertaining to <br />the Mined Land Reclamation Act, 34-32-112). <br />We have reviewed the 112 permit application and found it to be complete; that <br />is, the submittal minimally addresses the requirements of the law. During our <br />review, we have outlined by exhibit the items which must be more thoroughly <br />addressed by the applicant prior to submitting the application to the Board <br />for approval. Please address the points below as thoroughly as possible, and <br />do not hesitate to contact us if you require guidance or have questions. <br />Please note that we are asking Skelton, Inc. to submit the responses to our <br />concerns, as well as the currently submitted information, in a single volume <br />format, by exhibit (see 112 application page 3), to cover both pit areas. The <br />single volume, 112 format application would not only enhance our ability to <br />review the application, but would reduce duplicative efforts for yourself and <br />minimize confusion in the future.
