any gravel or road gravel pits via the county road adjacent to the premises. Lessee <br /> agrees that no access to the premises will occur across other land owned by the <br /> Lessor. <br /> 4. This Lease shall terminate prior to the expiration herein before provided <br /> upon the removal by the Lessee of all gravel, road gravel and mud rock from the <br /> demised premises, and the Lessee notifies the Lessor of their intent to terminate. <br /> 5. Lessee shall have the right to remove, if necessary, and where it may <br /> consider advisable, any soil, waste sand or overburden from such gravel, road gravel <br /> and mud rock, and to deposit the same within the mining permit boundaries. <br /> 6. As the full and complete purchase price for such gravel, road gravel and <br /> mud rock as the Lessee may remove from said premises under this Lease, Lessee <br /> agrees to pay the Lessor the sum of seventy five cents (.75) cents per cubic yard for all <br /> gravel, road gravel and mud rock, removed from the premises. Lessee shall forward to <br /> Lessor monthly reports showing the quantity of materials removed during the preceding <br /> month according to load tickets, with dates of loading. The reports shall be forwarded <br /> to Lessor, with the monthly payment, by the 15th day of the month following any month <br /> in which materials are removed. <br /> During certain months of the year it may be impractical to remove materials <br /> because of weather conditions. No reports shall be required for any month during <br /> which no materials have been removed. <br /> 45 <br />
