Lessee shall keep a strict and accurate record of all materials removed from the <br /> leased premises and shall make said records available to Lessor upon request. <br /> 7. In digging pits for the purpose of producing and removing materials, <br /> Lessee shall make separate stock piles of topsoil, overburden and waste substances. <br /> On completion of the removal of materials from pits that have been dug on the <br /> leased premises, Lessee will place any unused waste substances and materials used <br /> for roadways back into the pits from which the substances and materials were removed, <br /> with clean overburden, which should be free from any large debris, placed on top <br /> Lessee will backslope the pits using the substance and materials as have been <br /> removed from the pits. <br /> Before termination of the Lease, Lessee shall level all areas where roads and <br /> stockpiles have existed. <br /> 8. Lessee shall not remove any materials other than those specifically <br /> mentioned in this Lease, without receiving the express written consent of Lessor. <br /> 9. Subject only to the terms of this Lease, Lessor reserves to itself the full <br /> use and occupancy of the premises herein before described. <br /> 10. Lessor assumes no responsibility for any accident or injury on said <br /> premises during the term of this Lease. Lessee shall indemnify Lessor against liability <br /> and all claims for damages and injuries to persons or property that are claimed to have <br /> resulted from the activities or omissions of Lessee or its agents or employees during <br /> 46 <br />
