WITNESSES AND EXHIBITS <br />The parties to the Hearing must mail (post marked by <br />December 7, 1998), to all parties and the Mined Land Reclamation <br />Board (in care of the Division of Minerals and Geology), a list of <br />witnesses and copies of exhibits which shall be introduced at the <br />hearing, except that exhibits too large to mail shall be listed <br />separately and adequately described. Said Exhibits shall include <br />signed and notarized proxy designations {originals to the Mined <br />Land Reclamation Hoard, in care of the Division of Minerals and <br />Geology, with copies to all other parties). The entities who did <br />not attend the Pre-hearing Conference will not be allowed to <br />present exhibits or introduce witnesses at the Hoard hearing <br />unless approved by the Board. Said entities will not be given an <br />opportunity to conduct cross-examination of any witnesses that <br />testified during the presentation unless approved by the Board. <br />Members of the public wishing to testify at the Formal <br />Public Hearing may submit written and/or oral testimony to the <br />Board during the designated time period for public comment at the <br />hearing. Although only one copy of written testimony is required <br />for non-party witnesses, it is recommended that 12 copies be <br />provided to allow for full Consideration by the Board and staff. <br />A11 documents, exhibits and photographs gresented as <br />evidence at the Formal Publie Hearing sill become part of the <br />administrative record. Upon request, a party may recover any <br />evidence introduced by that party, if no action for judicial <br />review is commenced within thirty (30) days of the date agency <br />action in this matter becomes effective. <br />VI. PROCEDURE <br />The Division, parties and members of the public shall make <br />presentations in the following order. The time limits set out <br />below are maximum limits and shall be strictly enforced. The <br />Hoard, in it6 discretion, may allow additional time when <br />warranted. The Board has the right to limit any redundant or <br />irrelevant testimony. At the conclusion of each presentation, and <br />within time limits set by the Hoard, there will be an opportunity <br />to conduct cross-examination of any witnesses that testified <br />during the presentation. <br />
