• Current Status Initially, the civil penalty was fixed at $1550 but was reduced in an <br />assessment conference to $1050. The operator requested a Board hearing on the NOV, <br />which took place on 11/17/93. The Board upheld the violation and the reduced penalty <br />of $1050. The topsoil was taken to the approved stockpile area and the fine was paid. <br />The NOV is now closed. <br />Violation # NOV C-93-085 <br />Issuing Aaencv CDMG <br />Date of Issuance 6/8/93 <br />Description of Violation Failure to maintain culverts on site. Two 24" culverts leading <br />to the sediment pond were damaged during topsoiling operations. <br />Current Status The initial civil penalty was set at $1550 but was reduced in an <br />assessment conference requested by the operator and held on 8/10.93. The reduced <br />amount was $1050. A technical revision was submitted 4 days after the NOV was <br />issued to permanently remove the culverts and replace them with a Swale. The TR was <br />approved. The culverts were removed and the Swale installed. Fine of $1050 was paid <br />by the operator. The NOV is now closed. <br />Violation # NOV C-93-055 <br />• Issuiop Agencv CDMG <br />Aate of Issuance 4/16/93 <br />Description of Violation Failure of Rimrock Coal Company to list Landmark <br />Reclamation, Inc. et al. as an operator of the mine. Also, the NOV was issued for <br />failure to identify persons or other entities which own or control the applicant in <br />the Identification of Interests section of the permit and failure to demonstrate that <br />persons who own or control the applicant or operator do not own or control other <br />operations which have outstanding violations with other coal mine operations in <br />the Applicant Violator System (AVS). <br />Current Status Initially, the civil penalty was fixed at $800 but was reduced in an <br />assessment conference on 6/16/93 to $550. The Identification of Interests section <br />in the permit was corrected and work commenced on sorting out the linking of <br />Landmark Reclamation, Inc. To Randall & Blake Oklahoma, Inc. For three unpaid <br />cessation orders issued to three separate permits in Oklahoma o ]0/1/82 n <br />``5/19/95, the CDMG sent a letter to Landmark stating that the civil penalties for ~_y 5 .~, ~ ~ <br />these violations must be paid by 8117/95 or that Landmark must demonstrate that) <br />I(~there was no link.
