• Violation # NOV C-93-146 <br />Issuing Agencv CDMG <br />Date of Issuance 1113!93 <br />Description of Violation Failure to maintain sediment pond. Failure to clean out <br />sediment from near primary discharge tube. <br />Current Status An assessment conference was held and the violation was upheld. The <br />settlement agreement of 2/8/94 fixed the civil penalty at $l 150. Sediment pond was <br />cleaned. Fine was paid and NOV is closed. <br />violation # NOV C-93-111 <br />Issuing Agencv CDMG <br />Date of Issuance 8/12/93 <br />Descripsioa of Violation Failure to pass surface runoff from a disturbed area into a <br />sediment pond or other treatment facility. Violation applied to the breach of the <br />ditch/sump around the topsoil stockpile. <br />Current Status The necessary repair work was completed by July 30, 1993. Fine of <br />$1350 was paid by the operator. The NOV is now closed. <br />Violation # NOV C-93-100 <br />Issuing_At?encv CDMG <br />• Date of Issuance 6/21/93 <br />Description of Violation Failure to monitor wells according to program approved in <br />the permit. Evidence did not demonstrate that four wells were monitored at the <br />required quarterly intervals. <br />~rreot Status The original proposed penalty was set at $1600. The operator <br />requested a formal Board hearing which took place on 11/17/93. The Board upheld the <br />violation but reduced the civil penalty to $1350. Well monitoring was corrected and <br />submitted to the Division. Fine was paid and violation is closed. <br />Violation # NOV C-93-053 <br />Issuing Agencv CDMG <br />Date of Issuance 5/19/93 <br />Description of Violation Failure to remove, store, protect and identify topsoil. Failure <br />to pass disturbed area to a sediment pond or other treatment facility. Violation applied <br />to the placement of a trailer outside the approved disturbed area where the topsoil was <br />not placed in an approved stockpile. Also, topsoil from the haul road was not being <br />stored in approved stockpiles. <br />-2- <br />• Revised for permit renewal 11/17/95 <br />
