Current Status An assessment conference was held and the violation was upheld. The settlement agreement of 2/8/94 fixed the civil penalty at $l 150. Sediment pond was cleaned. Fine was paid and NOV is closed. violation # NOV C-93-111 Issuing Agencv CDMG Date of Issuance 8/12/93 Descripsioa of Violation Failure to pass surface runoff from a disturbed area into a sediment pond or other treatment facility. Violation applied to the breach of the ditch/sump around the topsoil stockpile. Current Status The necessary repair work was completed by July 30, 1993. Fine of $1350 was paid by the operator. The NOV is now closed. Violation # NOV C-93-100 Issuing_At?encv CDMG • Date of Issuance 6/21/93 Description of Violation Failure to monitor wells according to program approved in the permit. Evidence did not demonstrate that four wells were monitored at the required quarterly intervals. ~rreot Status The original proposed penalty was set at $1600. The operator requested a formal Board hearing which took place on 11/17/93. The Board upheld the violation but reduced the civil penalty to $1350. Well monitoring was corrected and submitted to the Division. Fine was paid and violation is closed. Violation # NOV C-93-053 Issuing Agencv CDMG Date of Issuance 5/19/93 Description of Violation Failure to remove, store, protect and identify topsoil. Failure to pass disturbed area to a sediment pond or other treatment facility. Violation applied to the placement of a trailer outside the approved disturbed area where the topsoil was not placed in an approved stockpile.
