Rimrock Mine Permit # C-89-074 List and Status of Violations
The applicant or any persons controlled by or under common control with the applicant
has not either had a federal or state mining permit for surface coal mining operations
suspended or revoked in the last 5 years prior to the date of submission of this
renewed application or forfeited a mining bond or similar security in lieu of bond.
The following violations are listed in chronological order:

Description of Violation Failure to provide required information regarding ownership
and control of the coal mining operation.
Current Status The Operator appealed the violation and, in an assessment conference
on 7/19/95, the assessment officer recommended vacating the NOV. The NOV was
originally upheld by the Division Director but was finally vacated on November 9,
1995.

Date of Issuance 12/6/93
Description of Violation Failure to provide copies of the performance warranty
documents and Section 2.03.4 of the permit available for public view at the County
Courthouse in Las Animas County.
Current Status The NOV was vacated by Division Director Mike Long, stating that
the lack of the materials at the Courthouse was a permit defect and not the fault of the
operator.
Violation # NOV C-93-151

Description of Violation Failure to inspect sediment pond for the third quarter of
1993.
Current Status The NOV was upheld and the fine was reduced from $650 to $550 by
Division Director. Inspection was performed two days after issuance of the violation.
Fine was paid and NOV is closed.
