Violation # CO-93-054 Issuing Agency CDMG Date of Issuance 4!13/93 Description of Violation Cessation Order for failure to achieve sufficient compaction to ensure stable embankment slopes with a minimum safety factor of 1.3. Current Status Initially, the civil penalty was fixed at $2000 but was reduced in an assessment conference on 6/16/93 to $550. During the assessment conference, it was demonstrated that the DMG's perception of a major problem with the embankment was unfounded. The reduced fine was paid and the CO is now closed. Violation # NOV C-93-005 IssuinE APencv CDMG Date of Issuance .1/28/93 Description of Violation Failure to construct pond to DMG rule requirements. Pond slopes approved in the permit conflicted with DMG requirements, although pond design was certified by a professional engineer. Current Stat s A technical revision was submitted in late January of 1993 to revise the pond slopes to meet the DMG requirements. This revision was subsequent]y approved and implemented. The initial civil penalty of $1000 was reduced in assessment conference to $250 for good arguments presented by the • operator. The fine was paid and the NOV is now closed. The following violations were issued to Randall and Blake Oklahoma, which later was potentially linked to Rimrock Coal Company through the AVS system: Violation # Cessation Order 82-04-52 TVl IssuinP Agencv State of Oklahoma Department of Mines Date of Issuance 8/1/82 Description of Violation Failure to perform contemporaneous reclamation on Permit 79/81-2082 in Haskell County. Current Status The CO was terminated by Oklahoma Department of Mines adm. inspection on 6/7/93. Reclamation was completed on the site. As of April, 1995, the penalty of $22,500 was still outstanding.
