Violation # CO-93-054 <br />Issuing Agency CDMG <br />Date of Issuance 4!13/93 <br />Description of Violation Cessation Order for failure to achieve sufficient <br />compaction to ensure stable embankment slopes with a minimum safety factor of <br />1.3. <br />Current Status Initially, the civil penalty was fixed at $2000 but was reduced in <br />an assessment conference on 6/16/93 to $550. During the assessment conference, it <br />was demonstrated that the DMG's perception of a major problem with the <br />embankment was unfounded. The reduced fine was paid and the CO is now closed. <br />Violation # NOV C-93-005 <br />IssuinE APencv CDMG <br />Date of Issuance .1/28/93 <br />Description of Violation Failure to construct pond to DMG rule requirements. <br />Pond slopes approved in the permit conflicted with DMG requirements, although <br />pond design was certified by a professional engineer. <br />Current Stat s A technical revision was submitted in late January of 1993 to <br />revise the pond slopes to meet the DMG requirements. This revision was <br />subsequent]y approved and implemented. The initial civil penalty of $1000 was <br />reduced in assessment conference to $250 for good arguments presented by the <br />• operator. The fine was paid and the NOV is now closed. <br />The following violations were issued to Randall and Blake Oklahoma, which later was <br />potentially linked to Rimrock Coal Company through the AVS system: <br />Violation # Cessation Order 82-04-52 TVl <br />IssuinP Agencv State of Oklahoma Department of Mines <br />Date of Issuance 8/1/82 <br />Description of Violation Failure to perform contemporaneous reclamation on <br />Permit 79/81-2082 in Haskell County. <br />Current Status The CO was terminated by Oklahoma Department of Mines adm. <br />inspection on 6/7/93. Reclamation was completed on the site. As of April, 1995, <br />the penalty of $22,500 was still outstanding. <br />Violation # Cessation Order 82-04-50 <br />IssuingAQencv State of Oklahoma Department of Mines <br />-4- <br />• Revised for permit renewal 11/17/95 <br />
