<br />Mr. O'Brien <br />Re: Gravel Extraction <br />June ?6, 1996 <br />Page 2 <br />failure of the applicant to undertake the requested use, or by vote of the Planning Commission at <br />a show-cause hearing which reviews violations of any conditions imposed upon the approval of <br />the permit. <br />The sales contract you provided grants you permission to seek the special use permit. However, <br />a deed will be required to verify the ownership. In this case, a document identifying Mr. Scanio <br />as the trustee for the ownership would be sufficient. The deed will allow staff to verify the <br />proposed use is actually within the property boundaries as well as the ownership verification. <br />The special use application checklist provided to you requests information to prove water and <br />sewer availability. Obviously, this is not completely appropriate for a temporary or cyclical <br />mineral extraction ai:d processing operation. rn staternent from you indicating that potable water <br />and sanitary facilities will be provided for the workers conducting the operation would be <br />sufficient for these items. <br />I would point out that a special use permit is only one of several permits that may be required for <br />the proposed extraction operation. As I mentioned eazlier, the Mined Land Reclamation Division <br />and Boazd may require a permit (staff contacted Mr. Jim Stevens at MLRB who is forwazding <br />information to you directly); there may be an air permit required for crushing and screening <br />equipment (contact Air Pollution Control Division and locally Mr. Emmet Hance at City-County <br />Health Department); and a stormwater dischazge permit (contact Colorado Water Quality Control <br />Division). <br />Your application did not indicate if the operation were a "wet" or "dry" type. Depending on the <br />answer, you may need a Division of Water Resources Well Permit and augmentation plan. <br />The property does not appeaz to be within the 100 years flood plain as depicted on the Federal <br />Emergency Management Agency (FEMA) Firm Map Community Panel No. 080147 0475B. <br />You may wish to verify the location of the proposed mining azea in reference to the flood plain to <br />determine if a Corps of Engineers 404 or National Pollution Discharge Elimination System <br />(NPDES) permit maybe required. <br />In closing the following items will be required to process the special use permit application: <br />Application fee S 163.00 <br />Statement regazding potable water and sanitation facilities provided during mining <br />operations. <br />• Deed indicating ownership and documentation for Mr. Scanio to act on behalf of owners <br />as trustee. <br />
