HART
COUHT`/ ATTORNEY
BOARD OF COUNTY COMMISSIONERS ~~r,FIVEC
DEPARTMENT OF PLANNING AND DEVELOPMENT J~1N 2 ~ 1996
June 26, 1996
Mr. Joseph O'Brien
vice President
Red Creek Ranch
7560 Highway 96 Nest
Pueblo, CO 31005
Deaz Mr. O'Brien:
Division of Mlneraie av~uiD9y
I received your application material requesting a special use permit to conduct mineral extraction
in an A-1, Agricultural (minimum 40 acre) Zone District. I have reviewed the applicable
regulations and have determined a special use permit for natural deposits extraction and
processing would be required prior to conducting any mining operations. Although your
extraction activity may not require a Mined Land Reclamation Boazd Permit (depending on
volumes mined and other factors), the Pueblo County Zoning Resolution does not distinguish
between classes of mining operation. The Resolution places mining activities in the uses-by-
review ofthe A-1 Zone District which requires special use permit approval by the Pueblo County
Planning Commission prior to establishing the use or activity.
In reviewing your application materials, I find several additional items of information will be
necessary to begin processing the permit request. Your letter describes a "200 x 300 ft. disturbed
area". the accompanying map generally locates this azea. However, a special use permit is
granted for a specific location or azea and therefore requires a legal description and boundary
depiction on a map of sufficient scale to allow reasonable field verification by staff and other
interested parties. In your case, the legal description for the mining area may be the SE 1/4 r~IE
1/4 Section 24, etc. with a plot plan graphic to depict the 1.3 acre mining area as generally within
the identified 1/4 1/4 section.
You indicate the mining operation to be "of temporary nature". A special use permit is granted
to the land and runs with the land, as such, it is usually approved without a proscribed duration.
Termination of the special use pennit could be accomplished by a request from the land owner at
a future date, by Planning Commission vote to not continue the permit after the first yeaz for
1120 COURT STREET, ROOM 200
PUEBLO, CO 81003-2819
(719)563-6100
FAX: (719)583-6376
~• nwr a as,ar a.a
• iii iuiiiiiiiiii iii ,
