(What, if any. is the lateral and vertical extent of the projected <br />ugradient mounding affect and the downgradient shadowing affect'?). <br />l4. An objector has expressed concern over the potential for exposure of contaminated <br />groundwater during mining. Please verify if the applicant has any knowledge or information of <br />existing contamination of water and/or soils either within the affected land, adjacent, or nearby <br />areas. <br />EXHIBIT H -WILDLIFE INFORMATION <br />15. The applicant lists on page 7 of the application 13.2 acres of backfilled wetlands while the <br />applicant states on page 8 that the operation will no[ create wildlife habitat. <br />pertains to the Phase I area. Comments received from the Colorado Division of Wildlife <br />(CDOW) indicate that the 13.2 acres of created wetlands would certainly qualify as wildlife <br />habitat. Also, the applicant lists Developed Water Resources (WR) and Industrial/Commercial <br />(IC) as the primary future land uses. The Division is in agreement with the comments of the <br />CDOW and suggests that the applicant list wildlife habitat as a secondary post-mining land use <br />rather than industrial/commercial. (If the applicant has plans for development of <br />industria]/commercial property during final reclamation, then the applicant will need to specify <br />where such industrial/cotnmercial property will occur and how it will be reclaimed). <br />EXHIBIT L -RECLAMATION COSTS <br />16. The reclamation cost will need to be revised to include itemized costs for the following: <br />backfilling, grading, and revegetation of created wetlands in the Phase I area <br />pit dewatering costs (assume active mining area during maximum disturbance is full of water) <br />contingency costs for liner repair (assume 20% of entire reservoir perimeter will need to be <br />ripped, relined with replacement clay/shale, and recompacted to OSE design specifications) <br />EXHIBIT M -OTHER PERMITS & LICENSES <br />17. Please indicate what permits, licences, or approvals may be needed prior to installation of the <br />overhead conveyor crossing Brighton Road as indicated on page 5 of the application. <br />EXHIBIT S -PERMANENT NIAN-MADE STRUCTURES <br />The 13.2 acre area <br />I8. In the absence of a commitment to maintain a minimum setback distance of 64 feet from all <br />permanent man-made structures within 200 feet of the proposed affected land, please address <br />how compliance with Rule 6.4.19 will be achieved for all such structures. <br />
