• <br />l9. The applicant specifies on page 5 of the application that a water well and pump used for crop <br />irrigation may be removed through the mining process. Based on the Division's recent site <br />inspection. it appears that several irrigation laterals may also be removed during mining. The <br />applicant notes on page ~ that the property owner owns these various structures. in order to <br />address how compliance with Rule 6.4.19 will be achieved for these structures.the Division <br />requests that the applicant provide a notarized statement from the owner of these structures that <br />they are not opposed to their removal during mining and that there are no easements, contracts, <br />or cooperative agreements regarding this irrigation system that will be adversely affected by the <br />removal of any such irrigation structures within the affected land. (If this specific language is <br />already incorporated in the lease agreement between the applicant/operator and the landowner, <br />please indicate). <br />Once again, I will look forward to your response on or before April l9, 2000 to allow adequate <br />time for review before the April 24, 2000 decision date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder. The applicant must also provide the Division with an affidavit or receipt <br />demonstrating that the change or addition was filed with the County Clerk and Recorder no later <br />than the close of business on the day the change was filed with the Division.
