In order to comply with the reyuirements of Rule 6.4.19 the <br />applicant may either commit to a setback distance of at least 64 feet for all such structures and <br />provide a revised copy of Exhibit C to demonstrate a setback distance of at least 64 fee[. As an <br />alternative, the applicant may either aj provide a notarized agreement between the applicant and <br />the person(s) having an interest in the structure, that the applicant is to provide compensation for <br />any damage to the structure, or b) where such agreement cannot be reached, the applicant shall <br />provide an appropriate engineering evaluation that demonstrates that such sultcture shall not be <br />damaged by activities occurring at the mining operation. <br />EYHIBIT D -MINING PLAN <br />4. On page 5 the applicant specifies that the deposit will be dry mined through the use of <br />dewatering trenches and pumps. In accordance with Rule 6.4.4(c) please provide a representative <br />cross sectional diagram of the working pit face and dewatering trench [o be employed. This <br />information may be added to Exhibit C -Mining Plan Map. <br />5. On page 5 the applicant specifies that an overhead conveyor will be used to transport aggregate <br />materials from the Tanabe Pit across Brighton Road over to the processing plant at the Howe Pit. <br />Please indicate if there are any permanent structures (supports) that will need to be installed <br />within the permit area as part of the overhead conveyor system. If yes, please provide the details <br />of such structures as they will likely need to be removed during final reclamation. <br />6. The applicant has provided on page 6 an estimate of the maximum disturbance to be expected <br />at any time. This disturbance is listed as 32.2 acres. Please indicate if this acreage includes <br />disturbance from Phase I that requires backfilling. If not, will the Phase I area be completely <br />backfilled and revegetated at the time of maximum disturbance? <br />7. The Urban Drainage & Flood Control District and several objectors have expressed concern <br />over possible impacts to the 1st Creek floodway channel. From review of the mine plan, it <br />appears that the applicant will maintain an adequate buffer from the channel and will not in any <br />way affect the channel during mining or reclamation. However, please verify if the applicant <br />plans to install any stormwater drainage structures within or immediately adjacent to the channel. <br />If so, please provide a representative cross-sectional diagram of such feature and provide a <br />written explanation of the purpose and type of structure. If the structure is within the permit area, <br />please state whether it will remain or be removed at the conclusion of mining activities. <br />8. The mining plan and Mining Plan Map, Exhibit C does not contain any information regarding <br />the design and construction of the reservoir liner. In order to demonstrate compliance with Rule <br />3.1.6 of the Construction Material Rules & Regulations the applicant will need to provide the <br />Division with one of the following items: <br />A) A copy of the SEO's letter approving the proposed liner design and a copy of the design and <br />specifications for inclusion into the applicant's application prior [o the Division's <br />recommendation date. <br />
