McArdle <br />Page 2 <br />Responding to Item 3 of your request for information to supplement that .- <br />in Exhibit C, you will find that the mining plan is clearly indicated on <br />Exhibit C-2 as is the outline of the affected land. <br />Exhibit D, Item 1 - The total volume of topsoil and overburden to be <br />stripped and stockpiled is listed tabularly by mining unit in Exhibit D. The <br />only material expected will be B Horizon material used to create the two dams. <br />In Exhibit E we state: "A concerted effort will be made to stockpile what <br />(topsoil) is available." You asked that we clearly indicate whether or not <br />we plan to salvage all of the available topsoil. We feel that our verbage <br />conveys that intent. In brief, the answer to your question is yes. <br />Exhibit D, Item 2 - The mining plan calls for stripping topsoil and <br />overburden estimated to be between 0 and 18 inches in the area to be affected. <br />This is not inconsistent with the test pit information, which by reference to <br />Exhibit C-1 you will note contains substantial test pit data outside of the <br />proposed mining area. You will find the test pit data within the mine plan <br />area to be consistent with the statement in Exhibit D. <br />Exhibit D, Item 3 - The diversion and sediment pond dam dimensions will <br />be consistent with the state engineers office recommendations and will be less <br />than ten feet in height so they will not require a dam permit. The sediment ~ <br />pond is to be established under the provisions of the stock pond statute and <br />is to be left in place at the request of Terry Grazing after the completion <br />of operations. The plan view dimensions of the dams, the pond and the diversion <br />are all to scale on exhibit C-2. The elevation dimensions will be consistent <br />with the topography information on Exhibit C-2. The materials for construction <br />of the dam will be obtained from the material overlaying the aggregate beneath <br />the topsoil. The state engineers office is currently working with us on some <br />recommendations for minor improvements in sediment pond location and on an <br />augmentation plan. <br />Exhibit D, Item 4 - The table indicating disturbance categories of the <br />affected acreage will be revised as appropriate based on our upcoming confer- <br />ence. <br />Exhibit E, Item 1 - In conformance with Rule 6.1 (f) no slope steeper <br />than 2 to 1 will remain after reclamation. Slope information can be derived <br />from the revised two-foot contour postmining or reclamation map: Exhibit F. <br />
