The operator needs to provide additional detail regarding compliance with <br />- '' applicable Colorado water laws and regulation governing injury to existing <br />water rights. The following items must be addressed to be in compliance with <br />Rule 6.4.7; <br />(a) The operator must locate on the map tributary water courses, wells, <br />springs, stock water ponds, reservoirs and ditches on adjacent lands where <br />such structures may be affected by the proposed mining operation. Please <br />locate all of the above-mentioned features on a map, Please also identify all <br />wells and water rights held by adjacent property owners. This information can <br />be obtained from the Division of Water Resources, Office of the State <br />Engineer. <br />Response: In order to clarify this information, we have revised our maps to <br />enable the reviewer to find this information. The location of all tributary streams, <br />water courses, wells, springs, stock water ponds, reservoirs and ditches within <br />200 of the proposed mining operation as required by Rule 6.4.3(b) is found on <br />Map # 2 Tellier Gravel Pit -Pre-Mining Conditions Map. A revised discussion of <br />these items is found in the text accompanying Revised Exhibit G. <br />(b) The operator must provide an estimate of the project water requirements <br />including Flow rates and annual volumes for the development, mining and <br />reclamation phases of the project including evaporation loss. Appropriate <br />documentation of the excising water rights also needs to be submitted. <br />Response: A discussion of the water requirements for this project are found in <br />Revised Exhibit D. The estimated water consumption from evaporation is found <br />in the narrative on water usage in revised Exhibit D. Documentation on the water <br />rights owned by the landowner are found in revised Exhibit D <br />~ , 11. The Operator did not include if a substitute water supply plan for the <br />replacement of ground water depletions during the mining phase will be <br />submitted to the State Engineer's Office. The operator will need to submit <br />proof of compliance with the State Engineer before exposing the groundwater <br />in the mining operations. <br />Response: The Applicant's consultant was informed by Mr. Kent Holt of the <br />Steamboat Springs office of the Colorado Division of Water Resources in a <br />telephone conversation on 22 October 1998 that a substitute water supply plan <br />would not be necessary for this project, since the water resources of this basin <br />are not over adjudicated.
