Rule 3.1.5(9) requires the <br />following information to be submitted to the Division; <br />(a) a narrative that describes the approximate location of the proposed <br />activity; <br />(b) the approximate volume of inert material to be backfilled; B,pCY~c~Y/ SO,~X % ut=~' <br />~c, a signed affidavit certifying that the material is clean an inert, as defined in <br />Rule 1.1(20); <br />(d) the approximate dates the proposed activity will commence and end; <br />(e) an explanation of how the backfilled site will result in apost-mining <br />configuration that is compatible with the approved post-mining land use; and <br />_~ (f) a general engineering plan stating how the material will be placed and <br />• stabilized in a manner to avoid unacceptable settling and voids. <br />Please submit this information. <br />Response: A statement and signed statement containing this information have <br />been added to Revised Exhibit E. <br />13. On page 12, the operator states that no permanent water bodies are proposed <br />~r in connection with the reclamation and revegetation plan. However, the <br />reclamation plan states that overburden will be replaced the edges of the <br />excavated pond area, and one or two islands will be constructed in the middle <br />of the pond. Will the pits be converted into ponds? The islands will also need <br />to be shown on the reclamation plan map if they are to be included in the plan. <br />Please clarify this discrepancy. Please note that if ponds are to remain in the <br />reclamation plan, an augmentation permit will need to be obtained from the <br />Division of Water Resources. <br />Response: The Applicant recognizes that the mention of "ponds" almost <br />interchangeably with the term 'lnretland areas' in the original permit application <br />may have been confusing, therefore we have deleted any references to the term <br />"ponds" in the permit application since we are not proposing any ponds as a part <br />of the final reclamation plan for this location.
