ENVIRONMENT, INC. • • PAGE 2 <br />March 19, 1993 <br />CRS 34-32-116(1)(h) at that time referred to Disturbances of <br />Hydrologic Balance to surface and ground water. I found this in a <br />copy of the ACT dated March 12, 1982, section 34-32-116(7)(g) in <br />the most recent copy of the Act contains the same language. <br />The attached plans are submitted for the Divisions review and <br />approval by the Board. Mr. Robert Krehbiel's letter of March 15, <br />1993 explains the capacities of the ditch and show that the new <br />ditch is capable of delivering more water than can now be delivered <br />to the properties down ditch at this time. It also explains the <br />reasoning behind the design. <br />B&B is the second to last user of ditch water on the CKP, the <br />Schmidt Ranch is the last user. We have discussed this relocation <br />and design with Mr. Lloyd Gerrard who leases the Schmidt Ranch and <br />he has indicated he has no problem with the relocation. <br />We are asking this request be expatiated, B&B has to have this <br />relocation completed before water starts flowing in the ditch in <br />mid-April otherwise they will disrupt the flows during construc- <br />tion. They have pipe and supplies sitting on the site waiting for <br />the go ahead. I request the plans be taken before the Board at the <br />March 24-25, 1993 for their approval. I realize this is short <br />notice but do not think it will take more than 5 minuets for the <br />Board to approve the plans. These plans have been engineered and <br />the Division should have no problem with the change since it was <br />approved with a condition in the original permit. It is also <br />evident from the information presented we will not be disturbing <br />the hydrologic balance by moving the ditch. In fact, by running <br />the water thru the pipe we will actually increase the amount of <br />water leaving the site, because there will not be any seepage <br />losses associated with an unlined ditch. <br />If you need more information please call me at the above <br />number. Also let me know as soon as possible what time we will be <br />heard by the Board next week.
