The two maps contain the information necessary to show the relocation plans and other design features. There is also a cover letter addressed to me containing information B&B Excavating has had prepared by Wright Water Engineers, for submittal to the Mined Land Reclamation Board concerning the relocation of the CKP Ditch that crosses this pit. This ditch relocation was planned for and is part of the original permit application approved on October 24th, 1986 and bonded on May 24th, 1990. This can be confirmed by reviewing page 9, paragraph 3 of the application book which reads: "Prior to the start of operations on Stage 3, it will be necessary to relocate the CKP Ditch so that it runs along the south side fence line in the 30 foot setback area. It is the mining operator's understanding that the relocatiors project is their responsibility to insure that no harm comes from the relocation. " In addition, the Reclamation Plan Map - Exhibit F shows the proposed new location of the ditch that was approved. By comparing the original Reclamation Plan Map with the Maps submitted you can see we are using the same location along the south property line. When the application was approved the Division addressed this ditch relocation by adding a stipulation to the permit that says: "The operator shall submit to the Division plans for relocation of the CKP ditch. Plans shall be consistent with the requirements of 34-32-11ti(1)(h). The Plans shall be approved by the Mined Land Reclamation Board prior to the excavation of the existing ditch. "
