• August 5, 1987
Page Two
The only facility on Crystal River's lands which we want to have removed is the
dirt bean, and that only for the distance horn the intersection with the paved road
running by the main ranch Rouse to the paint that there is an existing break in the
bean for vehicle access purposes near the calving sheds. The balance of the berm
material to be removed which is not used as described in the preceeding paragraph
may be loaded, hauled and placed in the feedlot north and west of the haul road.
This will improve the feed lot's utility by making its surface gently sloping and
uniform. Snowmass should take care to cover the paved haul road with dirt at the
point of crossing, so as to absorb the impact of the trucks crossing the road to
obtain access to the feedlot. We suggest a common point of crossing so as to
rninnnize any damage to the road. Then Snowmass need only replace any fences it
must remove to facilitate the berm removal project, remove the dirt placed to
cushion the paved road and seed the excavated area with appropriate grasses. The
Crystal River Ranch Company will construct any other {ences it deems necessary.
As consideration for leaving the remainder of the dirt berm Snowmass will pay
Crystal River $1,500 and give Crystal River all of the fencing materials, manhole
covers, concrete pipe, corrugated steel pipe, irrigation valves and other items
appertaining to the sprinkling system at the Diamond A Ranch for Crystal River's
use in establishing a sprinkler along the top of the remaining dirt berm in order to
make it more appealing.
We understand that your permit may not explicitly allow final reclamation as
• described -above. Our desires were expressed when the original permit was
reviewed, but the issue apparently was not pursued because Snowmass's operations
were expected to continue for many years. We would be pleased to assist you in
any reasonable way to obtain [he necessary permit revisions and to provide any
further inforrr~atron the [3oard or its staff may require.
We also recognize that Snowmass will need ongoing access and surface rights to the
areas subject to its reclamation obligations in order to obtain bond release. We are
willing to grant Snowmass such rights and to execute a mutually acceptable
agreement defining the obligations of the parties.
We will be pleased to meet with you and the Division to discuss any of these issues.
Yours truly,
Douglas .Poison
Vice Pr'sident
dlp/rnve
cc: Prank Erisrnan, Esq.
•
4-46b (flew ~-14-87)
