Loadine and Related Facilities <br />The Crystal River Ranch Company, a Colorado general partnership ("Crystal <br />River"), is the successor in ownership to the Anschutz Land 8t Livestock Co., Inc. <br />• of the ranch lands subject to one of the easements held by Snowmass for its coal <br />transportation and loading facilities in Garfield County. The Anschutz Corporation <br />is one of Crystal River's general partners and is the owner of the lands subject to <br />Snowrnass's other easement. You have advised us that Snowmass is preparing to <br />totally reclaim these facilities in accordance with its permit from the Colorado <br />'dined Land Reclamation Board. <br />As we have discussed, several of these facilities would be very useful to our future <br />ranching operations on these lands and should be left in place in their present <br />condition. These include the entire paved haul road, the adjacent cedar fence <br />which screens the road, the landscaping installed by Snowmass along the road, and <br />the truck dump pad. These existing improvements are described generally on <br />Exhibits BI, B2 and B3 to the Agreement, Release and Conveyance of Easement <br />dated December 2, 1983, between Anschutz Land do Livestock Co., Inc. and <br />Snowmass. You should be aware that, prior to Snowmass's operations, the haul road <br />route •uas used as a ranch road and hay was stored at the truck dump pad site. <br />The retaining wall at the truck dump pad should be left in place rather than being <br />dismanteled, in order to avoid serious erosion. However, it represents a safety <br />hazard if left "as is" due to the height of the retaining wall. We request that dirt <br />from the dirt berm, taken from the area described in the succeeding paragraph, be <br />hauled to the truck dump pad and he dumped over the edge, filling the void area <br />below the retaining wall to the point that about one-third of the height of the <br />retaining wall remains exposed.
