4 <br />(2) The FS must be notified of any proposed alterations to the exploration plan and access on die coal <br />exploration license (CEL). Any changes to the existing plan arc subject to FS review and may result ht additional <br />conditions of use. <br />(3) A11 locations of drill pads and new temporary road alignments must be approved in the field by lbc <br />Paonia Uisrrict Ranger or his or her representative bcfote any ground disturbance or construction begins. <br />(Q) Licensee will be required to obtain a Raad Use Permit (RUh) from the FS prior to using existing <br />National Forest System Roads (NFSIi) to access the CIiL or on the CL•L. A perfnrmancc hood will be rcyuired as <br />port of the RUP. Roadwork will be performed only upon authorization of the Paonia llisu•ict Ranger, and will follow <br />construction specifications ideutificd by the FS. Roads will 6e desi~ncd and constructed to provide maximum <br />stability and protect the surface resource. All roads will be ma(ntaincd ar constructed to FS specified standards fur <br />either temporary or classified roads, as appropriate and approved by the FS, with a design speed of 15 mph. With <br />respect ro ttse of NFSR 711, there maybe sptciftc work roquired for stabilizing the road to handle larger vehicle <br />vaffic to prevent additional sedimentation into the Ury Fork of Minnesota Creek. Phis work will be performed as <br />directed by the Paonia District Ranger. <br />(5)'femporary roads and drill pads will be designed to ndnimlzc erosion and sedimentation. Drill pads will <br />be sized to minimize sucfacc disnubance and will use vegetation cleating rather than full soil disturbing colstruction <br />lechniquca wherever possible to minimize the amount of soil disturbance. Dri11 pads will be designed to prevent ur <br />diminish overland flow from entering the site during precipitation events. Pad sites will be sloped to drain all spills <br />on site precipitation into the mud pits. If necessary, pits will be pumped out to reduce their content and insure that <br />overflow dots not occur, Fluids will be contained and disposed of at s Stale approved site <br />(G) Licensee will be responsible For soil preservation/protection and final reclamation. Licensee will be <br />responsible for soil losses due to erosion and gullyhzg. Topsail stockpiles will be located to minimize soil <br />contamination or loss. Soil from reed pits will be stockpiled £or use during reclamation. Rock material will be <br />stockpiled separately. , <br />{7) Staging areas must be approved in advance by dte Paonia District Ranger. <br />(g) All surface dlsttubing activities including reclamation must be supervised by a responsible <br />representative of the licensee who is aware of the terms and nonrlidotts of the projects permits/liccnscs. Licensee <br />will have an authorized representative on site at all times. A copy of the appropriate permits/licenses must be <br />available for review at the project site and presented upon demand to any FS ofFtcial. <br />(9) Licensce will be responsible (cr controlling and eradicating noxious weed infestations on the drill sties <br />and access roads from the date of discovery up to the point of release of the Colorado Division of Minerals and <br />Geology reclamation bond and associa[ed reclamation liability. Any herbicides used must be LPA and FS apprrved <br />and will be applied at the recommended rates. <br />(10) Reseeding will be complctetl using a certified weed free sotvee of seed. Licensee will be responsible <br />for controlling spread oF, and eradicating noxious weeds until the NS accepts final n:clatnation. Any hay or straw <br />used shall be certified as weed free.
