Phis examination must be done by or under the <br />supervision of a quatifled resource specialist approved by the NS. An arceptable report must be provided to the PS <br />identifying the anticipated effects of a proposed action on endangered or threatened species or their habitats. <br />Scc. 8. 130ND--The licensee shall file with the Colorado State Uffice a compliance bend in the amount of $18,000 <br />W ensure cgmp)ixnce with dte terms and conditions of the license and the regulations. <br />Sec. 9. USE OFDATA--The licensee shall Furnish to the Uncompahgre Field Office Manager copies of all data <br />{including, but not limited to, geological, geophysical, and core drilling analyses) obtained during exploration. The <br />licensee shall submit such data at such time and in such form as required by the Uncompahgre Fictd Ofcec Manager, <br />the authorized officer, or the surface management agency; or as spceified in this license or in the exploration plan: <br />The confidentiality of atl data so obtained shall be maintained until after the azeas involved have been leased or until <br />such time as dte Uncompahgre Field Office Manager dderminas that making lht: data uvnilablc to the public would <br />not damage the competitive position of the ticenscv, whichever crimes first. The authorized offcer Wray require the <br />licenses to collect and to report ground and surface water data available in rho conduct of the approved exploration <br />plan. <br />Scc 10. TRANSFEK OFLICENSE-Transfer of this license shall not be effective until it is approved by the <br />authorized officer. <br />Sec. 11. MoUIFICA'1'ION OF i,ICLNSE•-(a) The licensee may request a modification of the oxploratinn plan if <br />geologic or other conditions warrant. <br />(b)'1'he authorized officer may adjust the terms and conditions of the license, including the stipulations, or the <br />Uncompahgre Field Office Manager may direct adjustment in the exploration plan when unlin•eseen conditions arc <br />encounlcred that could result in substantial surface disturbance or damage to the environment or to improvements, nr <br />when geologic or other physical egnditions warrant• <br />(c) Any modification of the exploration plan is subject to approval by Ihu Uncnmpah~rc Field Office ManaEcr. <br />Sec. 12. RELINQUISHML'NT OP J,ICLtNSF-=1'he )icensee may relinquish this license, in whole or in pv~t, by filing <br />in the Coloradv State Office a wri![en relinquishment. 1'he relinyuishmcnt shall be effective the date it is filed, <br />subject to the continued obligation of the licensee and his surety: (a) to comply with the terms and cvnditions of the <br />license, the exploration plan, and the regulations and. (b) to provide for rho preservation of mty permanent <br />improvements on the Licensed lands. <br />Sea 13. RfiVOCAT[ON OF' LICENSE=This [icense may be revoked for noncamplinnce with the terms and <br />conditions of the (icense, the approved exploration plan, or the regulations after the Licensee has been notified of <br />such violation and rite licensee has filled. to corrcet the violation within the time specil led in such notice. <br />Sec. 14. EQUAL OPPORTUNITY CLAUSE--This license is subject to the provisions of Fxccutivc Ocder No. <br />11246 of Sepu:mber 24, 1965, as amended, which sett forth the nondiscrimination clauses. A copy ol'this ordor may <br />be obtained frgm the issuing office. <br />Sec. 15. SPECIAL STIYULATiONS- (a) (1) Licensee shall notify the Paoniu District Kangcr at least one week <br />before opetatiuns are to commence on National forest System lands (N1~S).
