Sec. 4. MULTIPLE USE--(a) Tltis License shall not adversely affect valid existing rights acquired pt•ior to liccrtse <br />issuance on [he lands described herein. <br />(b) Thu granting of this license shall not preclude the issuance of other licenses, permits, or Icuscs aztd shall not <br />preclude otter developments of the same lands. <br />(c) Operations under this license shall not unreasonably inu:rFere with or endanger any other operations or use <br />authorized pursuant to the provisions of any other act or regulation. <br />(d) The United States reserves the right to sell or otherwise to dispose of Federal lands under existing law ar <br />under laws ht:reafter enacted. insofar as such disposal shall not materially interfere with rho rights of the licenscc. <br />(c) If any of Ute 1[censed lands shall have been or may bo entered and patented with a reservation of mineral <br />deposits to the Uni[ed States, the licenscc shall observe such conditions as provided by law aS to [he use attd <br />occupancy of the surface of those lands. <br />Sec. S. PROTECTION OF SURFACE, NATURAL ]2ESOURCLrS, AND IMPROVEMGNTS•Thu licensee agrees <br />to take n:rsonable srcps to prevent operations under this license from unnccessarlly causing or contributing to soil <br />uosion; damaging crops, forge, or timber; polluting air and wutcr; or damaging improvements owned by the United <br />States and other patties. Upon any partial or total rclinquisbntenq upon the cancellation or expiration of this license, <br />or at ¢ny other time prior thert:lo when required, the licensee shall, to the extent deemed necessary by the licensor, <br />(a) fill eery pits, ditches, and other excavations, (b) remove or cover alt debris, and (e) so far as rcason,•lblypossible, <br />restore the surface of the licensed lands and access roads to t}tcir former condition, including the removal of <br />su•uctures. The licenser may prescribe the steps to be t•tltea and the restoration to be made with respect to the <br />licensed lands and improvements thereon. <br />See. 6. FROTF,CTION OF CULTURAL AND YALEONTOLOGiCAi. RESOURCES • The Forest Scxvice (FS) is <br />responsible for assuring chat the licensed lands are examined to determine if cultural resources are prtseat and to <br />specify rtutigaGon measures. Prier to undertaking any surface disturbing activities on the lands coursed by this <br />liccnso, the licenscc or operattx, unless notified to the contntry by the FS, sha1L• <br />(1) Contact the FS to detetntine if a site specific cultural resource inventory is requited. <br />(2j L'ngage the services of a cultural resources specialist acceptable to the FS ro conduct a cultural resource <br />inventory of the area of proposed surface disturbance, The operator may elect to inventory an area larger titan the <br />area of proposed disturbance to cover possible site relocation which may n:sult from environmental or other <br />considerations. An acceptable inventory report is to be submitted to the FS for review and approval at the time a <br />sutiace disturbing plan of operations is submitted- <br />(3) Implement mitigation measures required by the FS and the )3urcau of L end Managcrnent (]3LM) to preserve ar <br />avoid destruction of cultural resource values. Mitigation may include rclueation of proposed facilities, testing, <br />salvage, and rewrdudon or other protective measures. All costs of the inventory and mitigation will be home by the <br />licenscc or operator, and all data and materials salvaged will remain under the jurisdiction of the U.S. Governcnettt as <br />appropriate. <br />The Licensee or operator shall immediately bring to the attcntiort of the FS and BLM any cultutnl or palwtological <br />resources or any other objects of scientific interest discovered as a result of surface operations under this license, and <br />shall leave such discoveries intact until directed to prucced by FS and BLM. <br />Sec. 7. PROTECTION OF ENDANGERED OR TPItEA'L'fiNED SPECIES - The FS is responsible for assurint <br />that the licensed land is examined prior to undertaking any surface disturbing activitica to determine effects upon :my <br />plant or animal species listed or proposed for listing as endangered or threatened or their habitats.
