Case No. 94CW036, Findings of Fact, Conclusions of Law and
Decree of the Court Approving Absolute and Conditional Ground
Water Rights, Plan of Augmentation and for Change of Water Rights,
Application of the City of Black Hawk,
Page 11
its depletions. Accordingly, at Applicant's request the plan of augmentation decreed herein will
provide for augmentation ofthe depletions to North Creek caused by pumping ofthe new well at the
new Plant. Depletions are estimated to be 2 percent of water pumped. Annual pumping is estimated
to be 1400 g.p.d., or 1.57 acre-feet per year. Depletions at 2 percent aze estimated to be 0.0314 acre
feet per year. The well will be located in the S W'/e of Section 26, Township 3 South, Range 72 West
of the 61h P.M., in Gilpin County, Colorado. The source of water for the well will be fractured
aquifers tributary to North Clear Creek. No water right is decreed for this well by this decree.
16. Water Requirements of the City of Black Hawk: The City of Black Hawk is located
approximately 35 miles west of Denver at the confluence of Gregory Gulch and North Clear Creek in
Gilpin County. Water requirements for the City were determined by Leonard Rice Consulting Water
Engineers, based upon the City's curzent demand and projected near-term future water requirements.
Projections were computed by applying water demand factors for the various types of development
for assumed levels of development. Estimated near-term future water requirements which will be met
by this plan of augmentation aze described below:
16.a. Demand to be Augmented under Plan of Augmentation: For this plan of
augmentation, estimated demand is 614 acre-feet per year, with an average daily demand of 548,000
g.p.d.
16.6. Consumptive water requirements: Consumptive use is the percentage of
water diverted from a stream system that is not returned through surface runoff or subsurface return
flow and constitutes the net amount lost to the stream as a result of application of water to beneficial
use. Annual average consumptive use by the City of Black Hawk equals net stream depletions and is
estimated to be 2% to 5% of diversions. For purposes of this decree, Black Hawk has agreed to
augment depletions at the 5% rate for in-house use and at a 90% rate for irzigation use.
Total future consumptive use is estimated to be 39 acre-feet annually for this plan of
augmentation. These amounts are broken down as follows:
16.6.(1) In-house consumptive use (both residential and commercial) is
estimated to be 30 acre-feet per year under this plan of augmentation based on 604 acre-feet of
demand.
16.6.(2) An estimated 90 percent of water applied to irrigation will be lost to
the stream system due to evaporation during the application process and to evapotranspiration from
the plants and soil surface following application. The lands upon which water is applied for irrigation
