Case No. 94CW036, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Absolute and Conditional Ground <br />Water Rights, Plan of Augmentation and for Change of Water Rights, <br />Application of the City of Black Hawk, <br />Page I2 <br />use under this plan will be measured and will be reported on the accounting reports provided to the <br />Division Engineer. This plan for augmentation assumes 2 feet of water will be applied to irrigated <br />lands, with a limit of 10 acre-feet. Irrigation returns are assumed to be 10% of the water applied to <br />irrigation. These values will be reflected in the accounting reports. A total of 9 acre-feet of annual <br />consumptive use is estimated for ] 0 acre-feet of water applied [o irrigation use for a maximum of 5 <br />acres of lands under irrigation, under this plan of augmentation. <br />16.c. Depletions for the Black Hawk-Central City Sanitation District's proposed <br />well described in paragraph 15, above, are estimated to be 2 percent of water pumped. Annual <br />pumping is estimated to be 1400 g.p.d., or 1.57 acre-feet per year. Depletions at 2 percent are <br />estimated to be 0.0314 acre feet per year. <br />17. Augmentation Sources: The following sources will be used for augmentation for <br />the water rights listed in paragraph 15, above, when those rights are diverting under this plan of <br />augmentation and causing net out-of-priority depletions after credits for return flows from treated <br />wastewater effluent for in-house use and from irrigation return flows: <br />17.a. By the Fourth Amendment to Application in this matter, Applicant has <br />withdrawn with prejudice its claim in this Application to use any water derived from interests in the <br />Farmers' High Line Canal and Reservoir Company as a source of augmentation in this case. <br />17.6. The Golden City and Ralston Creek Ditch, a/k/a Church Ditch, water <br />rights: There are a total of 5,710.64 inches in the Church Ditch, a carrier ditch. As set forth in <br />paragraph 18, below, Applicant seeks to change 52.1 Church Ditch inches to allow the use of said <br />inches in this plan for augmentation as well as for other purposes. The Church Ditch decrees, <br />Applicant's pro rata ownership thereofattributed to the 52.1 inches, and the decreed diversion points <br />therefor are more specifically described in paragraph 18, below. <br />17.c. Water leased from Coors Brewing Company: The City currently leases 24 <br />acre-feet of consumptive use water annually from the Coors Brewing Company. The sources of <br />water leased include what are commonly known as Vidler Tunnel water, Berthoud Pass water, <br />Henderson Mine water, and Eisenhower Tunnel water. <br />17.d.
