Case No. 92-C W-059, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Conditional Appropriative Rights of <br />Substitution and Exchange, Application of The City of Black Hawk, <br />Page 2 <br />The consolidation for trial purposes did not merge the three actions into one, and the parties to one <br />action did not become parties to the other actions merely by virtue of this consolidation. On October <br />24, 2000, this Court entered an Order approving stipulations between the cities of Black Hawk and <br />Central and the opposers in Case Nos. 92-CW-059, 94-CW-036 and 92-CW-168. On January 8, <br />2001, the cities of Black Hawk and Central filed with the Court a Notice of Funding Pursuant to <br />Stipulation, certifying that funding was in place under the original stipulations. On January 17, 2001, <br />the Court ordered the termination of the consolidation of Case Nos. 92-C W-059, 94-C W-036 and 92- <br />CW-168 for trial on water quality issues. <br />On January 30, 2001, Applicant filed the First Amendment to Application <br />herein. <br />5. Timely statements of opposition were filed by the cities of Arvada, Central, <br />Golden, Thornton, and Westminster, Beverly Building Company, The Consolidated Mutual Water <br />Company, the Colorado Water Conservation Board, the Coors Brewing Company, The Vidler Tunnel <br />Water Company, Inc., Marvin Smith and Billie Jean Smith, M.D. et al. and William C. Russell, Jr. <br />6. On Apri12Q 2001, the Court ordered that the following prose parties were no <br />longer parties to this matter and were precluded from participating further in this matter: Mona M. <br />Dawkins; Agnes DePoyster; Steve DePoyster; Nick and Rosetta Feltis; John D. Ficke; Joan L. and <br />Ivan T. Gerardo; Kathy Gordon and David Moseley; Alan Gustafson; Dean Gustafson; Ron and <br />Bobbi Kohen; Bill Locricchio; O. Viki Luna and Forrest B. Robinson; Jeanna L. Macy; Cathy J. and <br />Lawayne G. Riedlinger; William D, and Penny Round; Marvin B, and Billie Jean Smith; Merritt E. <br />and Ramona J. Smith; Stephen R. Strauch; C. Wendell and Charla Waggoner; and Evelyn Waldman. <br />Objectors Michael and Kimberly Vincent remain pro se parties in this matter. <br />7. Timely and adequate notice of the application and First Amendment to <br />Application was published, as required by law, and the Court has jurisdiction over the subject matter <br />ofthis proceeding and over all persons and water rights affected thereby, whether they have appeared <br />or not. The time for filing statements of opposition has expired. <br />8. The Beverly Building Company, the Vidler Tunnel Water Company, Inc., the <br />City of Golden and Albert B. Dawkins, respectively, withdrew their statements of opposition. <br />9. Objectors the cities of Arvada, Central, Thornton, and Westminster and the <br />Coors Brewing Company entered into stipulations as to the water quality portion ofthis matter. <br />
