To the extent not contradicted by findings in this decree or othettivise withdrawn by stipulation or agreement, the statements in the application are true. 2. The Applicant filed its application in this matter on May 29, 1992. This matter was referred to the Water Referee by order of the Water Judge on May 29, 1992. On February 20, 1998, this matter was re-referred to the Water Judge. On May 15, 1998, the Court ordered that all issues relating to water quality in Case Nos. 92-CW-059 and 94-CW-036, the applications ofthe City ofBlack Hawk, and Case No. 92-CW-168, the application of the City of Central were severed from the respective cases and would be heard in a separate hearing. Under the Court's order, water quality issues would be heard first, and then the remaining issues in the cases would be tried later. Exhibit 20
