Case No. 92-CW-059, Findings of Fact, Conclusions of L.aw and <br />Decree of the Court Approving Conditional Appropriative Rights of <br />Substitution and Bxchange, Application of The City of Black Hawk, <br />Page 3 <br />] 0. The following parties have entered into stipulations with the Applicant on the <br />basis that those parties will not further oppose entry of a decree herein: <br />10.a. William C. Russell, Jr.; <br />10.b. Colorado Water Conservation Board; <br />10.c. The City of Thornton; <br />10.d. The Consolidated Mutual Water Company; <br />10.e. The City of Arvada; <br />10.E The City of Westminster; and <br />10.g. Coors Brewing Company. <br />11. The Applicant is a Colorado municipality. It owns and operates a municipal <br />water system and provides water to the area served thereby. <br />12. The Applicant seeks a decree for conditional appropriative rights of <br />substitution and exchange. Applicant claims the following described conditional appropriative rights <br />of substitution and exchange in Clear Creek, North Clear Creek and their tributaries. Applicant seeks <br />to divert by exchange up to 14 c.f.s. from Clear Creek, North Clear Creek, and their tributaries at <br />points ("exchange-to points') identified in paragraph 13., below, for direct use and/or for storage for <br />subsequent use, based upon the introduction of substitute supplies made available under the water <br />rights described in paragraph 14., below ("substitute supplies"). Applicant will make the substitute <br />supplies available at the points identified in paragraph 15., below (the "exchange-from points') by <br />making deliveries, by releases from storage, and/or by discharge of reusable effluent at the Black <br />Hawk-Central City Sanitation District Wastewater Treatment Plant. <br />13. Name, location and source of structures through which or into which <br />water will be diverted and/or stored by exchange ("exchange-to points"): <br />13.a. Upper North Clear Creek Pump Station No. 1. Located in the NE'/4 <br />S W%a of Section 34, Township 2 South, Range 73 West of the 6th P.M., Gilpin County, Colorado, at <br />a point located approximately 900 feet from the West section line and 2,100 feet from the South <br />section line of said Section 34. The source of water is North Clear Creek. <br />
