TIu Division may designate sudt rccbimed sites as requiring a stormwater permit <br />if the dischargt is a signif loan! rontributor of pollruatus to waters of the State. <br />IV COVERAGE UNDER THIS GENERAL PERMIT <br />Under this gentral permit, operators of stotmwater diraharges assoriated with mineral mining activity may be grained <br />authorization to discharge starmwater into wafers of the State of Colorado. <br />This permit doer not relieve the permittu firm rerponsibi(iry for rompliantx with any other applicable federal, state or <br />locol law, rule, standard, ordinance, order, judgonent or decree Nor doss this permit pre-empt or supersede the <br />authority ojbcal agencies to prohibit, restrict or control discharges of stormwarcr to stormdrain systems or other water <br />courses within (heir jurisdiction <br />Cer~cation under the permit requiter submittal of a rompleted application. Upon receipt of all required information, <br />the Division may aIlaw or dtsaAow rovrrage utrder the general ptrnrit within 30 days. <br />V. CRITERIA FOR REQUIRING INDIVmUAL PERMITS <br />Various other criteria tart be usad in evaGrating whether or not an individual permit may be required instead of a <br />genera! ptmtit. This information may rotne from the applcation, SWMP, or additions! information as requested by the <br />Division, and includes, btu it cot dmited to, the jollawing: <br />I. the quaGry of the mxiving infers (i.e., the presence of downstream drinking water imakes or a high quality <br />fishery, or jot preservation of high quaGry water); <br />1. the tyPc of mining activity, iruluding poWuion potemial; <br />3. the volume and type of materials hand4d,• <br />4. the siu of the jariluy,• <br />5. evidence of ronnontpAance under a previous permit jot the operation; and <br />6. the use of ohuniroLr within the stormwattr system. <br />In addition, an individual permit tray be rrqulrod when the Division has shown or has reason ro suspect that the <br />stormwater discharge is a signifiront romributor ojpoUwanu to waters of the State. <br />.
