Exemption for Pre-operational Mints <br />Pre-operational mining sites are not requirtd to obtain stormwater permits. The definitions of active and inactive <br />mining sites do not include sins where mining claims are being maintained prior to any disturbances associated <br />with the extraction, benefrciation, or processing of mined materials, nor sites where minimal activities are <br />undertaken jot the sole purpose ajmaintaining a mining claim. Sites at which only exploration hat been rnnducted <br />ar[ included in this exanption from stormwater pmnit requirements. <br />However, as clan; fication, claims on land when there has been past extraction, benefrciation, or procesing of <br />mining material, but there is crrrremly no active mining, are mnsidend inactivr sites and are subject to <br />• stormwater rrgulations. <br />
