Unless otherwise provided by the Division, the permittee shall have 30 days after such notification W both make the necessary changes to the plan snd to implement them. The permittx shall amend the plea whenever there is • change in design, construction, operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater discharges associated with industrial activity. Amendments to the plan may be reviewed by the Division in the same manner as described above. SWMP Deadlines Certification Certification of SWMP Completion and Implementation: For active mining operations existing on October 1, 1992, the permittee shall have implemented and be in compliance with their SWMP as soon as possible but no later than the emiversary date of their Mined Ind Reclamation permit that falls between July I, 1993 end Juae 30, 1994. The permittee shall submit a letter to the Division by that date certifying this. For new active faaGties (begiming operations after October I, 1992), and for all other active facilities applying after July 1, 1993, the SWMP shall be prepared and implemented prior to applying for coverage under the general permit, end certification of this shall be submitted with the application. For inactive mining operetions, applying before July 1, 1994, the petmvttee shall have implemented and be incompliance with their SWMP u soon as possible but no later than July I, 1994. The permittee shall submit a letter to the Division by that date certifying this. For those applying after July 1, 1994, the SWMP shall be prepared prior to applying for coverage under the general permit, and certification of this shall be submitted with the application. SWMP CertiFcalion. Any person signing a certification of the completion of the SWMP shall include the following language: 'I certify under penalty of law that a complete Stormwater Management Plan, in compliance with this the permit, has been prepared for my facility and has bxn implemented at my facility. Based on my inquiry of the person or persona who manage the system, or those persons directly responsible for gathering the information, the Stormwater Management Plan is, to the best of my knowledge end belief, true, accurate, and complete. I am aware that there are sigrificant penalties for falsely certifying the completion and implementation of said SWMP, including the possibility of fine and imprisonment for knowing violations.' 4. Prohibition of Nonstormwater Dischargts a. Except as provided in paragraph b, below, all discharges authorized by this permit shelf be rnmposed entimly of stormwater. Discharges of material other then stormwater must be addressed in a separate CDPS permit issued for that discharge. b. Discharges from the following sources that are combined with atormwater discharges associated with mining activity may be authorized by this permit, provided that the non-stormwater component of the discharge is identified in dte SWMP (see Part f.A.3.d of the permit): fire fighting activities, mcontaminated natural springs, end irrigation return flow. 5. Releases in Excess of Reportable Quantities This permit does not relieve the petmittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR 302. Any discharge of he7ardous material must be handled in accordance with the Division's Notification Requirements (see • Part II.A.3 of the permit).
