Unless otherwise provided by the Division, the permittee shall have <br />30 days after such notification W both make the necessary changes to the plan snd to implement them. <br />The permittx shall amend the plea whenever there is • change in design, construction, operation, or maintenance <br />which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the <br />SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater <br />discharges associated with industrial activity. Amendments to the plan may be reviewed by the Division in the <br />same manner as described above. <br />SWMP Deadlines Certification <br />Certification of SWMP Completion and Implementation: For active mining operations existing on October 1, 1992, <br />the permittee shall have implemented and be in compliance with their SWMP as soon as possible but no later than the <br />emiversary date of their Mined Ind Reclamation permit that falls between July I, 1993 end Juae 30, 1994. The <br />permittee shall submit a letter to the Division by that date certifying this. <br />For new active faaGties (begiming operations after October I, 1992), and for all other active facilities applying after <br />July 1, 1993, the SWMP shall be prepared and implemented prior to applying for coverage under the general permit, <br />end certification of this shall be submitted with the application. <br />For inactive mining operetions, applying before July 1, 1994, the petmvttee shall have implemented and be incompliance <br />with their SWMP u soon as possible but no later than July I, 1994. The permittee shall submit a letter to the Division <br />by that date certifying this. For those applying after July 1, 1994, the SWMP shall be prepared prior to applying for <br />coverage under the general permit, and certification of this shall be submitted with the application. <br />SWMP CertiFcalion. Any person signing a certification of the completion of the SWMP shall include the following <br />language: <br />'I certify under penalty of law that a complete Stormwater Management Plan, in compliance with this the permit, <br />has been prepared for my facility and has bxn implemented at my facility. Based on my inquiry of the person <br />or persona who manage the system, or those persons directly responsible for gathering the information, the <br />Stormwater Management Plan is, to the best of my knowledge end belief, true, accurate, and complete. I am <br />aware that there are sigrificant penalties for falsely certifying the completion and implementation of said SWMP, <br />including the possibility of fine and imprisonment for knowing violations.' <br />4. Prohibition of Nonstormwater Dischargts <br />a. Except as provided in paragraph b, below, all discharges authorized by this permit shelf be rnmposed entimly <br />of stormwater. Discharges of material other then stormwater must be addressed in a separate CDPS permit <br />issued for that discharge. <br />b. Discharges from the following sources that are combined with atormwater discharges associated with mining <br />activity may be authorized by this permit, provided that the non-stormwater component of the discharge is <br />identified in dte SWMP (see Part f.A.3.d of the permit): fire fighting activities, mcontaminated natural springs, <br />end irrigation return flow. <br />5. Releases in Excess of Reportable Quantities <br />This permit does not relieve the petmittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR 302. <br />Any discharge of he7ardous material must be handled in accordance with the Division's Notification Requirements (see <br />• Part II.A.3 of the permit). <br />
