State Req. <br />The Western Surface Agreement of 1977 between Peabody Coal Company <br />• and the International Union of United Mine Workers of America provides <br />for Health and Safety under Article III. Article III covers: The Right to <br />a Safe Working Place, Federal Mine Safety and Health Act of 1977, Mine <br />Heolth and Safety Committee, Access to the Mine, Reports, Safety Rules <br />and Regulations, Cooperation in Development of Mining Plans, <br />Preservation of Individual Safety Rights, Physical Examination, <br />Workmen's Compensation and Occupational Disease, Safety Equipment <br />and Protective Clothing Allowance, Maintenance, Special Safety Problem <br />Areas, and Settlement of Health or Safety Disputes. <br />Article XIV of the Contract pertains to Training. This section includes: <br />Orientation for New Employees, General Retraining Programs, Safety <br />Training for Specific Jobs, Maintenance Training and Rate of Pay, and <br />General Training Provisions. <br />Seneca is in continuing compliance with the above Act and 30 CFR <br />l Parts 48, 71, and 77, and the UMWA Contract Agreement of 1977. <br />• <br />2-13 <br />
