The [trine plan test indicates construction of one crossing. Please revise <br />the appropriate exhibit so the Mine Plan attd Mine Plan Map are consistent <br />Exhibit D, E, F and L have been updated to show that the Gurley Ditch will be crossed <br />twice during the life of the operation. <br />9. Please indicate the nature of rl:e strattem directly beneath the material to be [Witted. <br />The gravel bed lies directly on a sandstone shelf. This information is now included in <br />Exhibit D and referenced in Exhibit E as a deterrent to ripping before final reclamation. <br />10. Please indicate if the material will be [Witted with the excavation face mait:taitted at the <br />ftnal grade, or if a vertical excavation face that will require grade reduction at t/:e <br />completion of each phase of [Wining. <br />The pits will be excavated with nearly vertical faces at the point of advance and the side <br />slopes. The side slopes will be reduced as the face advances by filling to a 4h:ly slope <br />using refuse material. The advancing face will be finished to the projected disturbance <br />boundary as a 4h:ly slope. The operator will not encroach upon the disturbance <br />boundary during the final slope reduction activities. <br />11. TJte Colorado Division of Wildlife indicated that this area is severe winter range attd a <br />winter concetttratiott area for mule deer. Mule deer popttlatiotts itt Colorado are ott the <br />decline in quality and quantity. Therefore, to minimize impacts to tl:e mule deer <br />population in the proposed mining area, the Division recommends that the applicant <br />move [/te Phase 1 access road so it extends directly east from the ercavatiort area, <br />tnittimizing vehictt[ar disturbance to the sour/t of Pltase 1, along tTte crest of Natterita <br />Creek Canyon <br />The application should also include commitments to cntsh material only between April 1 <br />and October 31 of each year and to limit the material hauling hours to the period from <br />one half hour after sunrise to ate half hour before sunset during the winter months from <br />Novetnber 1 to March 31. <br />Operating hours of the pit will be controlled by the Montrose County Special Use Permit. <br />The Operator cannot make the commitments requested regarding limiting material <br />hauling hours. This type of commitment would severely limit the operators ability to <br />supply the first and last loads each production day, and restrict the operators success <br />when and if a large scale gravel requirement becomes available. However, demand for <br />gravel is customarily quite low during the winter months so material hauling will be <br />limited. Additionally, the Operator must crush material during winter months in order to <br />
