i ~ <br />6. A letter of agreement between the Operator and the Owner should be <br />submitted to the Division regarding topsoil stockpiles to be left in <br />place after reclamation is completed. The agreement should identify that <br />the topsoil is for the Owner's use only, not for sale. Piles should be <br />seeded to prevent erosion and sloped no steeper than 3H:1V. <br />7. In Exhibit D, Mining Plan it is stated that topsoil may also be <br />stockpiled in the northwest corner of the Phase I pit. Topsoil should <br />not be stockpiled in a pit because of possible erosion loss from flooding <br />within the pit, failure of the dewatering system, a major precipitation <br />event, etc. Please provide a statement that topsoil stockpiles will be <br />located out of the pit and on protected sites. <br />8. In the Exhibit E Reclamation Plan it states that areas subject to <br />reclamation will be covered with approximately six to twelve inches of <br />topsoil. However, through the Mining Plan it states that twelve inches <br />of topsoil will be replaced during reclamation. Please restate the <br />commitment to replace topsoil at the twelve inch depth as specified <br />through most of the text or clarify what your commitment is. <br />9. Please submit a plan addressing how blowdown waters will be contained at <br />the asphalt and cement plants and how oil unloading from trucks will be <br />handled, and how spillages will be contained. <br />10. The Reclamation Plan, Part Q, states that benching methods may also be <br />employed to achieve stabilization. Please clariy where benching may be <br />used. <br />11. Throughout the permit application the Operator reiterates that <br />consultation and directives will take place between the Owner and <br />Operator as reclamation progresses. The landowner is encouraged to <br />submit changes through the operator at this time. Permit approval <br />implies approval of stated plans. If substantial changes are made to the <br />permit after approval, including but not limited to acreage additions, <br />etc., an amendment will have to be filed with the Division. Minor <br />changes may require that a Technical Revision be filed. <br />12. The SCS seed mix submitted is for a recreational site while the permit <br />application states that wildlife will be the primary end use. Please <br />submit a native seed mix for wildlife habitat. It is understood that <br />there are wetlands on this site and that one of the primary uses of the <br />soil units described is for irrigated haylands. The Division requests <br />that the Operator submit as Exhibit J a description of prinicpal species <br />in the area of the permit. This information can be requested from the <br />SCS along with the native seed mix for wildlife. (See Rule 2.1.2(11) of <br />the Mineral Rules and Regulations). <br />
