Long <br />Division Director <br />Listed below are adequacy review comments on the above-captioned permit <br />application. Please submit your responses to the Division by March 15, 1993 <br />so that they may be reviewed by the permit approval date of March 23rd. <br />Please submit a signed agreement between the Operator and owners Mr. <br />Richard H. Grant and Daid J. Winograsky addressing agreed-upon <br />compensation should damage occur to structures located within 200 feet of <br />the affected area. This would include dwellings, other buildings, <br />fencing, and the shallow well on their property. (Section 34-32-115(4) of <br />the Colorado Mined Land Reclamation Act). Because an access road through <br />the Grant/Winograsky property may be used as a route to the Delta <br />Electric scales, please also submit a proof of legal right to enter <br />through Grant/Winograsky land. <br />Submit also a statement from or an agreement with the Denver and Rto <br />Grand Western Railroad that identifies the agreed-upon setback from their <br />tracks and telegraph lines. <br />It 1s acknowledged that the Operator will observe a 100 foot buffer <br />between the Yampa River and the affected area, and that the mature <br />cottonwoods along the tier will not be disturbed. Please submit a <br />statement that describes the impact that will take place across the 100 <br />foot buffer in ditching or providing for discharge from dewatering. <br />It is understood that the irrigation ditch to be moved from the mined <br />area to the northwest and west boundaries of the permit is an end-use <br />ditch and not a supply ditch. Therefore no agreement or easement will be <br />necessary from the Duquette Ditch Company. <br />Because excess topsoil may be marketed as mining proceeds, the Division <br />requests that topsoil stockpiles to be saved for reclamation be signed or <br />marked as such to protect them from unintentional sale. <br />
