<br />~~ <br />This Lease is subject to and Lessee shall comply with the <br />Garfield County condition on Special Use Permit: 1. That <br />no more than 20$ opacity of fugitive dust at plant and <br />County Road 109. <br />CMPROVEMENTS 6. Lessee at his expense shall install cattle- <br />RV T.F.CRF. F. <br />guards and culverts as required, and provide own electric <br />systems and meters and any incidental structures as may be <br />required. All such structures to be in compliance with all <br />Garfield County regulations. <br />TAXES 7. Lessee agrees to pay to Lessor on or before <br />January 31, 1978, and on or before said date, each year, <br />during which this agreement is in effect, all general and <br />special real estate or ad valorem taxes and assessments which <br />are levied against the premises and improvements thereon <br />of the subject site in excess of three dollars ($3.00) per <br />acre. Any additional taxes or fees incurred as a result of <br />the gravel operation shall be the responsibility of the <br />Lessee. <br />RESERVATIONS 8. A. Lessor excepts and reserves all the mines, <br />BY LESSOR <br />minerals, oil and gas in and under the premises hereby <br />leased. <br />B. Lessor shall have access to premises at <br />all times for whatever reason it desires. <br />C. Lessee guarantees to Lessor no nuisance <br />to farming and livestock operation and will be liable to <br />Lessor for any loss incurred by said operation as a result <br />of any aspect of the gravel operation. <br />D. It is understood that this Lease is to be <br />submitted to Travelers Insurance Company for its review. <br />In the event Travelers shall impose conditions or require- <br />ments upon Lessor which Lessor in its sole judgment and <br />discretion deem arbitrary and unreasonable, this Lease shall <br />be void. <br />-4- <br />
