<br /> <br />USE 4. Lessee shall use the premises only for mining, <br />extraction and stockpiling said sand, gravel and aggregate <br />and shall not use the premises or permit them to be used <br />for any trade, business, manufacture or occupation or any <br />nuisance or anything against public policy or for any purpose <br />or use in violation of any of the laws or regulations of <br />any governmental body or authority applicable to the premises. <br />All provisions and any possible revisions, amendments or <br />modifications of Lessors application and permits to State <br />of Colorado Mined Land Reclamation Board, or Lessors Special <br />Use Permit in Garfield County, Colorado, are incorporated <br />into and become an integral part of this agreement. Lessee <br />shall comply with all additional or any governmental agency <br />regulations and laws (OSHA, EPA, etc.). Lessee hereby holds <br />Lessor harmless for any violation or omission of compliance <br />with any of these various governmental regulations. In the <br />event of any such violation, this Lease and Agreement shall <br />terminate and constitute a default by Lessee. <br />MAINTENANCE 5. Lessee covenants that during the term of this <br />AND <br />REPAIRS Lease he will keep all fences, irrigation ditches, drains, <br />gates, water courses, springs and other things upon or about <br />such leased premises in good condition and in complete repair <br />and to return premises in as good condition as at the comm- <br />encement of lease. Lessee shall comply with all provisions <br />or reclamation imposed by the Mined Land Reclamation Board, <br />be liable therefor and solely responsible for compliance <br />therewith. Lessee will at all times and at this own expense <br />provide all road maintenance for those portions of roads <br />and easements used in the gravel mining operation within <br />the boundaries of Siever's Ranch and Development Company. <br />-3- <br />
