<br />E. Lessor shall have the right to examine <br />all weights and sales records of Lessee at any time during <br />working hours of Lessee. <br />F. This Lease shall not prohibit Lessor from <br />executing other Leases and Agreements with other persons <br />or entities for similar purposes on any other property <br />owned by Lessor and Lessor is hereby authorized to so execute <br />such agreements. The secondary Lessee will become responsible <br />for all road maintenance and dust control in operations <br />associated with gravel mining operations. <br />WATER 9. Lessor guarantees no water to Lessee and <br />assumes no liability in case of water supply Failure, ditch <br />washout, road washout or gravel operation interruption due <br />to any of the above. Any water necessary for the purpose of <br />washing gravel shall be purchased from Lessor at the add- <br />itional rate of twenty-five cents ($.25) per ton of washed <br />gravel sold by Lessee. It is agreed, however, that <br />any water necessary for Lessee shall be obtained from water <br />available on the premises. Costs associated with construction <br />and pumping shall be borne entirely by Lessee. <br />SURETY BOND 10. Lessee shall provide Lessor Surety Bond on <br />exact same terms as required of Lessor by State and County <br />agencies. <br />11. Failure to comply with all terms of this <br />Agreement shall be cause for cancellation of agreement in <br />its entirety; upon sixty (60) days written notice by Lessor <br />to Lessee. <br />12. Lessee shall furnish Lessor, within ninety <br />(90) days of execution hereof, at Lessee's sole expense, <br />a certified survey by registered surveyor of the legal <br />boundaries of the premises hereof. <br />-5- <br />
