The proposed dewatering operation will consist of <br />constructing a series of trenches with a backhoe down to bedrock <br />(claystone). These trenches will encircle the mining area by <br />phases and will route water to a low point on the property. <br />We are in the process of trying to obtain an agreement with CCWCD <br />on the use of their ditch. If we are unable to obtain one, we r, <br />will simply obtain an NPDES permit for a direct discharge to the <br />Platte River at the south end with the use of settling ponds. <br />The ditch would not need to handle both the capacity of <br />dewatering and CCWCD. Since the water used by CCWCD comes from <br />the same source, it would be feasible to use the dewatering <br />operation as part of their system. This is speculative since <br />they have not used their well system since 1982 and have been <br />told by the State Engineer's office to only use it if there is <br />abso:Lutely no other way to provide augmentation water. <br />RECLAMATION PLAN E%HIBIT E <br />4. The use of these pits for reservoirs is entirely feasible. <br />The :south Platte River Basin has a lack of available storage and <br />the +sddition of a series of reservoirs along the river is going <br />to be a welcome addition for augmentation of flows and capture of <br />waters that have historically been lost to Nebraska. <br />There are two sources of water that can be used for supplying <br />these reservoirs. First, a junior storage right will be filed on <br />the reservoir allowing it to divert as an adjudicated structure <br />in our water rights system. We are in the proces of preparing <br />this filing and will be submitting it to Water Court in the near <br />future (2 months). Table 1 is a tabulation of river calls placed <br />on Water District 2, Division 1 from the State Engineer's office. <br />As shown on this table, there are numerous opportunities to fill <br />reservoirs during the winter months when the call is off the <br />river. <br />r <br />r <br />
