Unless otherwise provided by the Division, the permittce shall have <br />30 days after such notification to both matte the necessary changes to the plan and to implement them. <br />The permittce shall amend the plea whenever there is a change in design, constntctioa, operation, or maintenance <br />which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the <br />SWMP proves to be ineffxtive in achieving the general objectives of controlling pollutants in stormwater <br />discharges associated with industrial activity. Amendments to the plan may be reviewed by the Division in the <br />same manner u described above. <br />3. SWA4P Deadlines. CertSfitstion <br />Cetti6rrtion of SWMP Completion and Lnplementatioo: For active mining operations cristittg on October 1, 1992, <br />the permittee shall have implemented and be in compliance with their SVJMP as soon ss possible but ao later than the <br />anniversary date of their Mined I.md Reclamation permit that falls betwcen July 1, 1993 and June 30, 1994. The <br />permittce shall submit a letter m the Division by that date certifying this. <br />For new active facilities (begiming operations afro October 1, 1992), cad for all other active facilities applying aker <br />July I, 1993, tCe SWMP shall be prepared and implearmted prior to applying for coverage under the general permit, <br />and certification of this shall be submitted with the application. <br />For inat~ve mining operations, applying before July 1, 1994, the permittce shall Lave implemented and be in compliance <br />with tlteir SWMP as soon as possible but no later tLan July 1, 1994. The permittee stall submit a letter to the Division <br />by that date certifying this. For those applying after July 1, 1994, the SWMP shall be prepared prior to applying for <br />coverage under tCe general permit, and certification of this shall be submitted witlt the application. <br />• SW11fP Certification. Aay person signing a certification of the completion of tLe SWMP shall include the following <br />language: <br />'I certify under penalty of law tLat a complete Stornnvater Management Plan, in compliance with this the permit, <br />Las been prepared for my facility cad has hem implemented at my facility. Based on my inquiry of the person <br />or persons who manage tCe system, or those persons directly responsible for gathering the information, the <br />Stormwater Management Plan is, to the best of my laowledge and belief, true, accurate, and complete. I am <br />aware that tltere are sigtificant penalties for Calsely certifying the completion and implementation of said SWMP, <br />including the possibility of fine and imprisonment for knowing violations.' <br />4. Prohibition of Non-stormwater DisclmrQes <br />a. Except as provided in paragrapL b, below, all d'c~hs nes authorized by this permit shall be composed entirely <br />of stotmwater. Discharges of material other then stormwater must be addressed in a separate CDPS permit <br />issued for that discharge. <br />b. Discharges from the following sources that ate combined witC stormwater discharges associated with mining <br />activity may be authorved by this permit, provided that the non-stormwater component of the discharge is <br />identified is the SWMP (sae Part I.A.3.d of the permit): fire figLting activities, wcontaminated natural springs, <br />and irrigation return flow. <br />5. Releases in Excess of Reaortable Otrantities <br />TLis permit does not relieve tCe permittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR 302. <br />Any discharge of Larardous material must be Candled in accordance with the Division's Notification Requirements (see <br />• Part II.A.3 of the permit). <br />
