The permittee requested that the storm event exemption included in the <br />federal guidelines be applied for discharge points 002, 003, 004, 005, 006 <br />and 008. The Division has stated that these points were ineligible for the <br />storm event exemption because any discharge from these points could include <br />mine drainage, spoil springs or truck wash water. The Division has <br />interpreted the federal guidelines as applying only to stormwater runoff, <br />and so the exemption does not apply to these points. However, the permittee <br />does have the option of collecting data to show that the volume of non- <br />stormwater in the discharge is not significant when compared to the <br />stormwater component. These data could then be used to justify a permit <br />amendment to reinstate the storm event exemption at applicable discharge <br />points. <br />4. The TDS requirements for 005 were changed from imposing a numeric limit, to <br />requiring a report on the feasibility of salt removal before any discharge <br />from 005 is allowed. <br />5. The permittee objected to a numeric limit for acute WET testing at 005, and <br />has presented information indicating that the maximum expected pit inflow <br />rate for mine water is 1 gpm. Since no spoil springs are expected, and the <br />volume of stormwater expected is substantially higher, the Division has <br />determined that there is not sufficient reason to apply an acute toxicity <br />_ .limit at this time. Therefore, discharge point 005 will be subject to the <br />same acute WET testing requirements as discharge points 002, 003, 004, 006• <br />and 008. <br />6. The monitoring frequencies at 004 and 008 for flow, pH and oil and grease <br />were changed from weekly to monthly during the winter months, due to tha <br />inaccessibility of the points during that time. <br />Kathryn Dolan <br />May 15, 1992 <br />VII.
