<br />COLORADO DEPARTMENT OF HEALTH, Water Quality Control Division <br />Rationale - Page 13. Permit No. CO-0000221. <br />~I <br />TERNS AND CONDITIONS OF PERMIT <br />- Monitoring for flow, oil and grease and pH at 004 and 008 has been changed <br />from weekly to monthly from November through February of each year. This is <br />due to the sites being very difficult to reach during the winter months. A <br />look at the monitoring history of these points (see Section V of the <br />Rationale) does not indicate any problems with meeting the permit limits. '~ <br />• <br />2. Reporting: Peabody Coal Company must submit a Discharge Monitoring Aeport <br />(DMR) on a quarterly basis to the Division. This report should contain the <br />required summarization of the test results for parameters shown in Part <br />I.B.1 of the permit. See the permit, Part I.B for details on such <br />submission. <br />3. Stormwater: The Division has not evaluated stormwater discharges as <br />outlined under the new Stormwater Regulation (40 CFA Part 122) as part of <br />this permit. <br />Additional Terms and Conditions <br />C <br />1. Materials Containment Plan: The permittee will be required to submit a <br />Materials Containment Plan. The plan shall address the prevention and <br />containment of spills of materials used, processed or stored at the facility <br />which, if spilled, would have a reasonable probability of having a visible <br />.. or otherwise detrimental impact on waters of the State. This plan is to be <br />submitted within 9D days of the effectivt date of the permit. See Part I.E <br />of the permit. <br />Specific Compliance Requirements <br />D <br />1. Submissions to the Division: The following are specific compliance items <br />which require permittee action. Public Notice <br />The permittee submitted several comments on the draft permit during the public <br />. notice period. The comments were handled as follows: <br />1. The reference to spoil springs being present at 005 was removed. <br />2. The listing of drainages affected by the discharge points was corrected. <br />
