The applicant must supply augmentation water for <br />the evaporative losses which will occur as a result <br />of the proposed ponds. The applicant stated that <br />Siegrist Construction Company owns six shares of <br />Hayseed Ditch stock and one share of the Rural Ditch <br />stock, however; no mention was made of an augmentation <br />plan. It appears that the applicant's water rights <br />are insufficient for augmentation since testimony in <br />a recent water court case casts doubt on the validity of <br />the Hayseed Decree. _ <br />2. The draw-down during dewatering could adversely affect <br />the Last Chance Ditch. The District requests that Weld <br />. County contact the Last Chance Ditch Company for their <br />input. <br />3. The applicant states on page 2 of his plans, note #7, <br />that "excess overburden material is to be spread <br />uniformly along both sides of St. Vrain Creek, in pond <br />access areas, and along north side of excavated areas <br />as indicated on Reclamation Plan." The proposed change <br />in the flood plain could affect land owners downstream <br />from the mining operation. <br />4. The proposed dewatering could adversely affect wells in <br />the area. <br />5. All historical drainage ways must be maintained. <br />The St. Vrain ~ Left Hand Water Conservancy District requests <br />that the applicant enter into a contract with the District to insure <br />that all of the above items will be rectified prior to issuance of <br />a permit. <br />k <br />
