<br /> <br />EXHIBIT D (Cont'd) <br />the south side of Alameda Parkway near the south center of the <br />Southeast Quarter of the Southwest Quarter, Section 24, Town- <br />ship 4 South, Range 70 West. Today this is the entrance to the <br />Chieftain South and Chieftain South South Pit. <br />On March 20, 1951, ROBCO was granted a permit by the City <br />and County of Denver to enter Alameda Parkway on the north side, <br />about one-half mile east of Rooney Stables. Today this is the <br />entrance to the North Chieftain Pit. <br />On June 6, 1952, approximately 90 acres of the 320 acres <br />in Section 23, Township 4 South, Range 70 West, were released from <br />the clay lease. <br />On May 18, 1959, another piece of acreage in Section 23, <br />approximately 0.90 acres, was released from the clay lease. <br />On October 31, 1974, a third piece of acreage in Section 23 <br />was released from the clay lease. This release was approximately <br />0.25 acres. <br />Thus, of the original 1360 acres in the clay lease dated <br />April 1, 1947, a total of approximately 91.15 acres, have been <br />released. Approximately 1268.85f acres are still under active <br />lease to ROBCO. <br />Mining began on the lease in 1947 and has progressed north- <br />westerly from the southeast corner and southeasterly from the <br />northwest area of the lease. Most of the mining occurred <br />on the leased property between 1947 and 1976. In 1976, <br />when a Mined Land Reclamation Permit became a requirement <br />under the Colorado Mined Land Reclamation Act, the site was <br />1 <br />-E- <br />
