1 <br />' EXHIBIT D <br />MINING PLAN AND TIhfETABLE <br />Location. The affected land is located immediately <br />south of Alameda Parkway, west of Denver and south of Green <br />1 Mountain, and about one-half mile east of the Dakota Hogback. <br />Easy access is obtained by using Alameda Parkway. <br />^ History. On April 1, 1947, a clay lease was executed <br />among Otis A. Rooney, Morris Rooney, Ruth Mchfurry, E. Nora <br />Pike and Eloise Derby Nelson and The Robinson Brick and Tile <br />'i Company, a Colorado corporation ("ROBCO"). The clay mining <br />v <br />lease gave ROBCO the right and privilege of prospecting for, <br />_ mining and removing all clay in the clay veins and clay <br />_ deposits on lands in parts of Sections 23, 24, 25 and 26 of <br />Township 4 South, Range 70 West, 6th Principal Meridian, <br />~ totaling approximately 1,360 acres. The lease was for a term <br />of ten (10) years and for as long thereafter as clay can be <br />mined and produced from said premises. <br />On July 1, 1947, an indenture was executed among Ruth <br />Mch7urry, E. Nora Pike and Eloise Derby Nelson and ROBCO <br />granting ROBCO the right and privilege of prospecting for, <br />mining and removing all of the silica in the silica veins and <br />silica deposits on the lands described in the clay lease. The <br />term of the lease was from April 1, 1947, and for as long <br />thereafter as silica can be mined and produced from said <br />' premises. <br />On September 25, 1947, a letter from the City and County <br />of Denver, signed by L. R. Hinman, Assistant hfanager, Improve- <br />s ments and Parks Department, granted ROBCO permission to enter <br />-5- <br />
