-50- <br />• • <br />Lynn: Just attempting, perhaps out of order, to anticipate something, <br />the record should reflect that my attempts to work with recla- <br />mation staff to obtain a legally enforceable reclamation plan <br />and Rade did some changes to the reclamation plan from the original <br />plan which was submitted. My understanding that Chris has been <br />advised of these by telephone and that has submitted a letter <br />on behalf of the company ratifying these changes and agreeing to <br />incorporate them as part of their reclamation plan. <br />Ward: Are you ready to speak to that? <br />Noffsinger: I would like to point out one thing. Rade told me Friday evening <br />about additional information we needed; (1) on air pollution, <br />(2) on water rights, you know. So I worked whatever it took, <br />told the right people to get it in the mail Monday morning. We're <br />trying to comply and supply the information, I just want that...and <br />new requirements do come up, and this is why we can, you know, I <br />don't think there be any problem because Rade has been very helpful <br />and we can get the information that's needed by January, or whenever <br />our date would be set. But new stuff does go on, and this is <br />one reason that, of course I misunderstand reading the laws and <br />regulations, there's no way to have a perfect pit application, <br />you know, when you first apply. I think we can, it's just a <br />matter of time and it wasn't incomplete with intent.... <br />Brown: Is this this permit you're talking about or the other permits? <br />Noffsinger: The other permits, you know we were talking about eight <br />Brown: Yeah. This one is complete. There's no question there. <br />
