Doc D-~ ate:1211112001 III'II'I~!II"II III <br />Section 785.17 Prime Farmlands. <br />i. <br />Since no prime farmlands were found in the pre-application investi- <br />gation required by 30 CFR 779.27, the requirements as presented in <br />this Section are not applicable to the present permit application. <br />Support for this conclusion can be found in the discussion docu- <br />mented previously under Section 774.27. <br />Section 785.18 Variances for delay in contemporaneous reclama- <br />tion requirement in combined surface and under- <br />ground mining operations. <br />'~ <br />No combined or concurrent surface and underground mining activities <br />are proposed within the mine plan area. Therefore, the variance <br />provisions of Section 785.18 are not applicable. <br />~~ Section 785.19 Surface coal mining and reclamation operations on <br />areas or adjacent to areas including alluvial valley <br />floors in the arid or semi-arid areas west of the <br />100th meridian. <br />(a) Scope. This Section applies to each person who conducts or intends <br />to conduct surface coal mining and reclamation operations in, adjacent <br />to or under a valley holding a stream in the and or semi-arid regions <br />of the United States west of the 100th meridian. <br />The general area contains the Canadian River, a perennial stream <br />valley and several tributary intermittent stream valleys. The mine <br />plan area contains valleys holding intermittent streams as shown on <br />785-2 <br />
