Section 785.19 (a) Continued. <br />• <br />Map 16, Kerr Mine Area Surface Water Hydrology. The tipple area is <br />adjacent to the Illinois River, a perennial stream. Stream buffer <br />zones described in Section 816.57 will be established to prevent <br />disturbance directly in or under the stream valleys shown on Map <br />16, Kerr Mine Area Surface Water Hydrology, and Map 17, Kerr Tipple <br />Area Hydrology. <br />(b) No person shall engage in surface coal mining and reclamation <br />operations subject to this Section, except under a permit issued by the <br />regulatory authority in accordance with this Section. <br />Kerr Coal hereby applies for a permit to mine, in accordance with <br />and having shown compliance with 30 CFR 785.19. <br />• <br />(c) Alluvial valley floor determination. <br />(1) Before applying for a permit to conduct, or before conducting sur- <br />face coal mining and reclamation operations within a valley holding a <br />stream or in a location where the adjacent area includes any stream in <br />the and or semi-arid regions of the United States, the applicant shall <br />either affirmatively demonstrate, based on available data, the presence <br />of an alluvial valley floor, or submit to the regulatory authority the <br />results of a field investigation of the proposed mine plan area and <br />adjacent area. The field investigations shall include sufficiently <br />detailed geologic, hydrologic, land use, soils, and vegetation studies <br />on areas required to be investigated by the regulatory authority, after <br />consultation with the applicant, to enable the regulatory authority to <br />make an evaluation regarding the existence of the probable alluvial <br />valley floor in the proposed mine plan area or adjacent area and to <br />determine which areas, if any, require more detailed study in order to <br />785-3 <br />
